On the 6. October 2020 the class of the Graduate School of Law at Kobe University, Special Lecture of Constitutional and European Law (30 hours) is starting. (One PhD candidate students participates in this class)
《Seminar of Constitutional and European Law at the Bachelor level》
・On the 2. October 2020, I made an orientation of the progression and an explanation of the contents of this seminar to the students. This seminar is aimed at the understanding of guarantee of the fundamental rights and freedoms under Japanese Constitution in comparison with its European standard under the EU Charta of Fundamental Rights.
・On the 9. October 2020, the topics picked up at this seminar is decided; constitutional problems concerning the disparity of Diet fixed number under Parliamentary democracy under the modern constitutionalism and the way of the protection of fundamental rights and freedoms.
・On the 23. October, the topic of the disparity of Diet fixed number was picked up; it was considered what the legitimacy of construction of Representatives is under Parliamentary Democracy and which relationship there is between the election system and the status of representatives.
・On the 30. October, the topic of the freedom of the economic activities was picked up; we considered the normative contents concerning the freedom of occupation and the protection of property right as the Constitutional rights.
・On the 6. November, the topic of the minority's right in the National Diet in Japan; we considered the significance and correct meaning of the right of the opposition parties in the Diet, esp. Article 53 of Japanese Constitution, under the principle of Parliamentary Democracy.
・On the 13. November, the topic of the subject of foreigners to guarantee the constitutional rights under Japanese Constitution; we considered the possibility for foreigners to guarantee the constitutional freedoms and rights under Japanese Constitution in comparison with the guarantee system of German Fundamental Law.
・On the 20. November, the topic of the freedom of obscene expression and defamation; we considered the constitutional problems, whether obscene expression and defamatory expression are protected as a kind of the freedom of expression under the Constitution or not.
・On the 27. November, the topic of the legal problems in the EU and its Member-States; we considered and discussed about what problems there are from the perspectives of the legal science in the EU and its Member-States.
・On the 4. December, we discussed about several topics from the legal viewpoints in the EU and its Member-States: esp. Brexit, the protection of individual's privacy, the rights of sexual minority, the fluctuation of the principle of the rule of law in the eastern countries and populism in the EU. And we chose the topic about the rights of sexual minority as the theme of the Students Co-Workshop with NTU of this year.
・On the 11. December, the topic of the legal system of the same-sex marriage and the rights of LGBT in the Member-States of the EU; we considered the guaranteeing situation of the same-sex marriage and the life partnership of same sex couple in the Member-States of the EU and the situation of LGBT in the eastern European countries, esp. Poland and Hungary.
・On the 18. December, the participating students discussed about the contents of the presentation in the Workshop concerning the legal situation of the sexual minority in the EU.
・On the 25. December, the students prepared for the presentation in the Workshop; they discussed and considered the legal situation of the rights of LGBT in Poland and Hungary.
・On the 8. January 2021, the students made a trial presentation about the Legal Intolerance of LGBT in the EU .
・On the 15. January 2021, we participated in the Co-Students-Seminar 2021 with EUTW, National Taiwan University, by online.
《Special lecture of Constitutional and European Law at the Graduate School level》
・On the 6. October 2020, Orientation of this Special lecture is held. At first this lecture takes the problem about what the right of privacy as a constitutional right protects, and as the second theme of this lecture, the problem about what the Constitutional Identity provided in Art. 4 Clause 2 of TEU means.
・On the 13. October 2020, the relationship between the free transaction and the principle of democracy in the EU was viewed and considered.
・On the 20. and 27. October, the legal situation in the Baltic States under the strong influence of the EU law was considered. How the linguistic minority in the Baltic States can be protected was especially picked up and considered in comparison with the situation in Ukraine and Russia.
・On the 10. and 17. November, the linguistic problem concerning German language was considered and discussed. There are some usage differences between Austrian-German and Germany-German. Therefore, as Austria became the Member-State of the EU in 1995, the EU made the exception rule of language usage to the trade rule within the EU for Austrian-German. And we considered why Germany opposed against such a special measure of the EU.
・On the 24. November and the 1. December, we considered the legal meaning of National Identity provided on Art. 4 Clause 2 TEU. Does it mean the sovereignty of the Member-States? Which relationship is there between the constitutional order and the national identity on Art. 4 Clause 2 TEU?
・On the 8. and 15. December, the participating student chose the topic for the presentation at the Students Co-Workshop with NTU of this year; A Struggle for the National Identity Concerning the Case of North Macedonia's Accession to the EU. And we discussed about it focusing on the problem about the relationship between the national identity and the linguistic right of the nation.
・On the 22. December, we talked and discussed about the situation in Greece, North Macedonia and Bulgaria.
・On the 5. January 2021, the student made a trial presentation about "A Struggle for the National Identity Concerning the Case of North Macedonia's Accession to the EU".
・On the 15. January 2021, we participated in the Co-Students-Seminar 2021 with EUTW, National Taiwan University, by online. And the presentation was chosen as the Best Presentation Award.
