Điều 108. Hồ sơ hưởng lương hưu

Article 108. Dossier for pension enjoyment

1. Hồ sơ hưởng lương hưu đối với người lao động đang tham gia bảo hiểm xã hội bắt buộc bao gồm:

1. A dossier for pension enjoyment for employees covered by compulsory social insurance must comprise:

a) Sổ bảo hiểm xã hội;

a/ The social insurance book;

b) Quyết định nghỉ việc hưởng chế độ hưu trí hoặc văn bản chấm dứt hợp đồng lao động hưởng chế độ hưu trí;

b/ The decision permitting an employee to stop working under the retirement regime or the document terminating a labor contract with an employee for enjoying the retirement regime;

c) Biên bản giám định mức suy giảm khả năng lao động của Hội đồng giám định y khoa đối với người nghỉ hưu theo quy định tại Điều 55 của Luật này hoặc giấy chứng nhận bị nhiễm HIV/AIDS do tai nạn rủi ro nghề nghiệp đối với trường hợp người lao động quy định tại Điều 54 của Luật này.

c/ The written record of assessment of the working capacity decrease, made by the Medical Assessment Council, for employees who retire under Article 55 of this Law, or the certificate of HIV/AIDS infection due to occupational risks, for the employees defined in Article 54 of this Law.

2. Hồ sơ hưởng lương hưu đối với người lao động đang tham gia bảo hiểm xã hội tự nguyện, người bảo lưu thời gian tham gia bảo hiểm xã hội gồm cả người đang chấp hành hình phạt tù bao gồm:

2. A dossier for pension enjoyment for employees covered by voluntary social insurance or employees having their period of social insurance premium payment reserved, including those who are serving imprisonment sentences, must comprise:

a) Sổ bảo hiểm xã hội;

a/ The social insurance book;

b) Đơn đề nghị hưởng lương hưu;

b/ The application for pension enjoyment;

c) Giấy ủy quyền làm thủ tục giải quyết chế độ hưu trí và nhận lương hưu đối với người đang chấp hành hình phạt tù;

c/ The written authorization for carrying out procedures for settlement of the retirement regime and enjoyment of pension, for those who are serving imprisonment sentences;

d) Văn bản của cơ quan nhà nước có thẩm quyền về việc trở về nước định cư hợp pháp đối với trường hợp xuất cảnh trái phép;

d/ A competent state agency’s document permitting an illegal emigrant to legally repatriate and settle in the country;

đ) Quyết định có hiệu lực pháp luật của Tòa án hủy bỏ quyết định tuyên bố mất tích đối với trường hợp người mất tích trở về.

dd/ The court’s legally effective decision annulling the decision on declaration to be missing, for missing people who reappear.
