We strive to ensure a safe, healthy, productive, secure drug-free working environment for all employees, contractors, customers, and the general public and to comply with the Federal Drug-Free Workplace Act and similar State laws.
Definitions
Legal Drug - includes alcohol, tobacco, vape, prescribed drugs, and over-the-counter drugs which have been legally obtained and are being used for the purpose for which they were prescribed and manufactured.
Illegal Drug - means any controlled substance, medication or other chemical substance that: (a) is not legally obtainable under federal law or (b) is legally obtainable, but is not legally obtained or is not being used for the purpose(s) for which it was prescribed or was intended. Thus, “illegal drugs” may include prescription and over-the-counter medications.
Alcohol - You may not use or possess alcohol while on SunWater Spa property, or while working on behalf of SunWater Spa (whether or not on SunWellness property). An exception may be made for certain Company sponsored events. The use or abuse of alcohol off the job, which impairs, to any extent, performance on the job, is also prohibited. Employees are also prohibited from reporting to work or coming onto Company premises or performing work related tasks off premises while under the influence of alcohol.
Marijuana/CBD - The use or abuse of marijuana off the job, which impairs, to any extent, performance on the job, is prohibited. You are also prohibited from reporting to work or coming onto company premises or performing work related tasks off premises while under the influence of marijuana. CBD is not considered an illegal substance. Using CBD as part of your wellness program is not monitored by the company.
Smoking/Vaping/Chew Tobacco - you may not smoke, vape, or use chewing tobacco while working on company property. These substances are personal preferences and will not be monitored by the company while you are off company premises. However, when returning to work after using one of these products, you must take necessary steps to avoid any offensive breath or odors.
Illegal Drugs - We strictly prohibit the illicit use, sale, attempted sale, conveyance, distribution, manufacture, purchase, attempted purchase, possession or transfer of illegal drugs, intoxicants or controlled substances, at any time and in any amount or in any manner. We further prohibit the use of prescription medications for which the employee does not have a valid prescription. If we have reason to believe that a federal, state or local law is being violated, we may refer the matter to the appropriate law enforcement agencies for investigation and possible criminal prosecution.
If you believe that the use of any legal drug, such as a prescribed medication or over-the-counter drug, may affect your ability to perform your job safely, the you must report your concerns and restrictions to your manager. You are responsible for checking with prescribing physicians and /or reviewing product packaging to determine whether the use of a particular medicine may pose a safety risk. We will then determine whether any work restriction, reassignment, transfer or other measure is appropriate. All such communications, past or present, will be kept confidential and released to other management personnel on a need-to-know basis or as required by law.
