Times Fabian Directly Contradicted Himself At Grate Trial Under Oath
This section consists of reposts from previous sections specfically highlighting the times that Fabian directly contracted his own testemony on the stand.
1. 1 hour 34 min 11 sec https://youtu.be/0jnndclBzPM?t=5651 Fabian says the bill is $18K and says he rarely testifies for the prosecution because they don't call him (gee I wonder why) which contradicts what he says at 17 min 28 sec where he says prosecutors refer cases to him https://youtu.be/0jnndclBzPM?t=1048 even stating he "The Court Psychologist for The Government" 14 min 30 sec, youtu.be/0jnndclBzPM?t=870
2. For the next couple of minutes Fabian fixates on Grate having ADHD. 54 min 10 sec https://youtu.be/0jnndclBzPM?t=3250 even though Grate didn't endorse having ADHD, Fabian was obsessed with stating that Grate had ADHD, claiming the "neurological testing" said he had it. later in the Cross examination below Weaver points out that Fabian ignored his own results where the results stated Grate DID NOT have ADHD and yet still tagged Grate with an ADHD diagnosis. PT3 23 min 1 sec https://youtu.be/nmO2yi59qOU?t=1381This is Malpractice as well as potentially perjury of testimony where Fabian lied about the test results being positive for ADHD in the direct examination. Greater detail will be laid out in the next section.
3. 1 hour 36 min 30 sec https://youtu.be/0jnndclBzPM?t=5790 Weaver directly asks Fabian does he have any degrees in genetics. Fabian reluctantly says No. Weaver then asks Fabian, Genetics is the study of hereditary attributes being passed from parents to Children, which Fabian answers Correct. Weaver makes Fabian agree that tall parents will likely have tall children as an basic example. Then Weaver makes a point that Fabian does not have a degree in genetics, and not an expert in generics. Fabian tries to side step this by answering, There's not the word genetic in that report I don't think. Which Weaver responded with, Right well but you have testified previously that you believe that the biology of parents makes someone more violent. Essentially that parent that children can inherent a gene for violence. You testified that way before haven't you? Which Fabian tries to sidestep taking about "certain twin studies in Australia about criminal genetics and that there is a good about of scientific literature in a word salad that ends with, I don't come here saying... um you know... I'm I'm not adhering to that opinion in this case. Weaver comes right back and says that You've testified that way before that it's in the genes that it's possible to inherit a gene to make you violent Which Fabian responds with, I said that there's a nature nurture argument with criminality and violence with parents certainly yes. So Fabian makes statements on a subject he was no formal knowledge of.
4, 1 hour 39 min 46 sec https://youtu.be/0jnndclBzPM?t=5986 Weaver asks Fabian how often does Fabian interview killers that "flat out announced they plan in keep killing once they get to prison. Fabian clinches his lips and claims "it's occasional." and Fabian doesn't believe he will kill again but acknowledges it does happen. Weaver then asks, You have no way of knowing do you? and Fabian responds after rolling his eyes, I don't know if he'll.... do that, no. Weaver just got Fabian to contradict his own testimony in 30 seconds.
5. 1 hour 45 min 7 sec https://youtu.be/0jnndclBzPM?t=6307 Weaver then gets Fabian to contradict himself multiple times weather or not he actually did diagnose Grate with an anti-social personality disorder.
6. 1 hour 47 min 5 sec https://youtu.be/0jnndclBzPM?t=6425
Fabian admits these words of mental health diagnosis can be used prejudicially. He wrote his article "a long time ago" but he is not running from this diagnosis Weaver interestingly points out that who actually reads these articles of intellectual word salad published in obscure magazines other than to say some someone was published
7. 1 hour 48 min 23 sec https://youtu.be/0jnndclBzPM?t=6503 Weaver shows the list of diagnoses that Fabian tagged Grate with. It was a list of ten diagnoses. Weaver goes through the list one at a time to show Fabian tag grate with each diagnosis even though Grate's symptoms did not match with at was stated in the DSM. Many of the diagnoses Fabian tagged Grate with went directly against the DSM By tagging grate with conflicting diagnoses where the DSM specially states no person can have together ever in their life. Example Fabian tags Grate with persistent depressive disorder and bi-polar even though the DSM states no person can be diagnosed with both. Fabian even admitted at 1 hour 51 min 1 sec https://youtu.be/0jnndclBzPM?t=6661 That it could take a year to definitively. understand a person's diagnosis a year, not a pre-trial evaluation or two or four. Yet Fabian tags me with ADHD after only meeting with him for an hour. Sure sounds like Fabian admitted to malpractice especially when Fabian admits, It's very difficult to be exactly right a 1 hour 31 min 23 sec https://youtu.be/0jnndclBzPM?t=6683 Weaver once again empsazied the DSM specifically. Weaver asks Fabian directly does he diagnose Grate have a persistent depression disorder listed in his report 1 hour 51 min 43 sec https://youtu.be/0jnndclBzPM?t=6703 Fabian says more so persistent depression disorder and ADHD which Weaver says that ADHD needs to be addressed separately. This also shows Fabian's bias against ADHD. 1 hour 51 min 6 sec https://youtu.be/0jnndclBzPM?t=6726 Weaver points out the Fabian contradicted himself again in this where Fabian claimed that Grate was likely experiences more hypomanic episodes. 1 hour 52 min 24 sec https://youtu.be/0jnndclBzPM?t=6744 Weaver states that Fabian tagged Grate with conflicting diagnoses can cannot be laid on the same person in their life after Fabian admits that it's unclear about hypomanic episodes even though Fabian predicted them in his report.
8. as stated just above in video 3 34 min 6 sec https://youtu.be/nmO2yi59qOU?t=2046 Fabian claims in the forensic world he supposes to be right 100% of the time, then contradicts himself by admitting he can't get this exactly right 34 min 58 sec https://youtu.be/nmO2yi59qOU?t=2098 35 min 6 sec https://youtu.be/nmO2yi59qOU?t=2106 Fabian states We can quibble about diagnosis going off on how he cannot "perfectly diagnose." and 35 min 22 sec https://youtu.be/nmO2yi59qOU?t=2122 then Fabian admits there never will be a perfect examination
