24 Hour Notice to Enter
A landlord may enter the rental property only for certain specific reasons:
In the case of an emergency such as a fire or broken water pipe
To make necessary or agreed repairs or alterations or supply necessary or agreed services
To exhibit the premises to prospective tenants or purchasers or contractors
To make a “pre-departure” inspection when the current tenant is moving or to inspect smoke detectors, or a annual inspection in government funded housing
When it is evident that the tenant has abandoned the premises
Pursuant to a court order
3 Day Notices - To Pay or To Cure
Counting the Days: Per AB-2343, as of September 1, 2019, weekends and holidays no longer count for the 3-DAY NOTICES.
Oakland: Landlord must submit a copy of 3 Day Notice to the Rent Control Board within 10 days of serving tenant.
30 Day Notice
Rent increases up to 10%.
Any other changes to the terms of their tenancy, such as:
increased security deposits
change of rules and regulations
removal of amenities
60 Day Notice
Rent increases over 10%
Termination of Tenancy - NOT under Rent Control or Just Cause
30 Day Notice
Tenants who have lived in the rental unit 12 months or less can be terminated with a 30 Day Notice to Move Out.
60 Day Notice
Tenants who have lived in the rental unit over 12 months can be terminated with a 60 Day Notice to Move Out.
AB 418 Domestic Violence
This bill reduces the time limit required for a notice to vacate for a tenant who is a victim of, or who has a household member who is a victim of, domestic violence, sexual assault, stalking, human trafficking, or abuse of an elder or a dependent adult, from 30 days to 14 days. Security Deposit accounting and distribution continues to be controlled by existing law. Additional protections provided under the law remain in place. Additionally, this law removes a previous “sunset” provision that would have resulted in an automatic repeal of the law, extending the law indefinitely.
