Updated Commercial Rates from 1st September
Contracts are issued based on a Standard Working Day (SWD) that includes the hours you are expected to be available for, plus a 1 hour rest break, but an individual or a series of days can be shortened to a Continuous Working Day (CWD) or a Semi-Continuous Working Day (SCWD) where lost breaks are compensated in Paid time off/reduced hours worked, while retaining the Full SWD fee.
NOTE: From 1st September 2022, the 11+1 contract is no longer acceptable, however the figures are quoted here for those crewmembers who are on long running jobs that were contracted before the termination date.
There are 2 types of SWD, which both comprises of a number of paid hours of work plus 1 hour unpaid lunch break
10 hour worked + 1 hour lunch aka 10+1. Frequently referred to as an 11 hr day. ie 0800-1300 + 1400-1900
11 hour worked + 1 hour lunch aka 11+1. Frequently referred to as a 12 hr day. ie 0800-1330 + 1430-2000
You will be paid your SWD fee in full for each of these day types, with any additional time or breaches, subject to the overtime clause
There are 2 types of CWD, which both comprises of a number of paid hours that INCLUDES a 20 minute break, based on and paid as, the equivalent SWD
10+1 SWD becomes a 9 hour CWD (8hrs40 work + 20 mins informal break) ie 0800-1700
11+1 SWD becomes a 10 hour CWD (9hrs40 work + 20 mins informal break) ie 0800-1800
You will be paid your SWD fee in full for each of these day types, with any additional time or breaches, subject to the overtime clause
Despite a legal and mathematical explanations of how a SCWD should be calculated, it seems that producers generally dictate a working pattern that does not correctly apply the appropriate compensation for loss of the entitled lunch break.
On a SWD, a loss of 30 mins lunch break would be compensated for by using one 30 minute overtime segments.
On a SCWD, the hours that you should be negotiating in order to be compensated correctly are:
10+1 SWD becomes a 9.5 hour SCWD (9hr worked + 30 mins lunch) ie 0800-1300 + 1330-1730
11+1 SWD becomes a 10.5 hour SCWD (10hr worked + 30 mins lunch) ie 0800-1300 + 1330-1830

Advisory Note:
Where a meaningful negotiation, or a rejection of dictated hours, has taken place, the SCWD has been agreed as above, however be aware that many, but not all productions, are dictating a 9.5+30 or 10.5+30 SCWD, which only compensates the lost break time at 1T rather than the Overtime fee you would otherwise be entitled to.
