Most of the time a letter from BECTU HQ results in payment. Where this approach fails BECTU will seek legal advice on your behalf.

What to do if the Company is going into Liquidation owing you money.

Liquidation is the formal means of closing a company when there are still liabilities which need to be dealt with, usually by selling assets.

If you hear that a company you have worked for have gone into liquidation still owing you money;

contact the Prospect/BECTU Helpdesk straight away

The Helpdesk team can explain what you can do to try to protect your position, which may include advising you to make a county court claim to get “judgement debtor” status; which will bump you up the list of priority in terms of getting paid - if the claim is processed before the liquidators come in.

Unfortunately there are no guarantees, but it may be your only chance of seeing your money. 

If a company goes into liquidation, and you are on the list as an unsecured creditor, it will be nigh on impossible to retrieve monies owed.
