Nota Introductoria
La reevaluación del arte rupestre peruano, es una necesidad obligada que debe ser asumida por las nuevas generaciones de estudiosos de este importantísimo componente arqueológico y patrimonial. En los últimos 50 años, el tratamiento del arte rupestre andino ha pasado por ciclos marcadamente diferenciados, desde la aplicación de metodologías y técnicas de registro de los sitios, la participación del Estado en las tareas de protección y conservación, hasta la formalidad legal para su intervención. Actualmente, la preocupación de los investigadores peruanos pasa por desarrollar bases científicas para contextualizar arqueológicamente el arte rupestre, siendo uno de los casos las investigaciones desarrolladas recientemente en el complejo de arte rupestre de Macusani –Corani, en la región de Puno.
Es probable, que el sur sea la región con más estudios rupestres en los andes peruanos, y en la que se ubican los sitios más emblemáticos con pinturas rupestres, petroglifos y geoglifos. En esta tarea, el aporte de estudiosos nacionales y extranjeros es más que notorio; sin embargo, el cuestionamiento ponderado y razonable que se haga a los mismos, es una licencia lícita que la investigación científica y la libertad de juicio concede.
El acceso público a los centros de arte rupestre, es una facultad y un derecho exclusivo de la comunidad tenedora y de todos aquellos que se sientan con el deber de asumirlos como suyos. Esta facultad, tiene tres niveles de prerrogativas frente el bien cultural: social, Institucional y científica. La de orden social determina el usufructo del bien para fines de conocimiento, identidad, goce y turismo. En tanto que la institucional, es una prerrogativa del Estado (en sus tres niveles de gobierno), que asume legal y administrativamente el grado de intervención del arte rupestre. Y finalmente, la facultad científica tiene como propósito fundamental ubicar al bien cultural en los parámetros explicativos que obliga la contextualización arqueológica del mismo y los fundamentos para su conservación y puesta en valor.
Considero que el comentario desarrollado por Gori Tumi Echevarría, está enmarcado en el contexto explicado líneas arriba; por tanto, involucra argumentos racionales estrictamente técnicos, plausibles de ser debatidos y cuestionados en el mismo orden en que su autor explicita sus comentarios. Es importante valorar críticamente estas contribuciones y avanzar en la formalización y el desarrollo ético de los estudios rupestres.

El estado de conservación de los sitios arqueológicos en el Perú, y en especial de los sitios con arte rupestre se debate hoy en una crisis general. Sitios como los de Macusani - Corani pelean por su supervivencia, principalmente porque la regulación legal que ampara los sitios arqueológicos peruanos es estructuralmente endeble para protegerlos. La principal ley que regula el estatus legal del patrimonio cultural peruano, la Ley General de Patrimonio Cultural de la Nación (Ley 29286), expone por ejemplo serios vacios legales que generan subrepticiamente problemas patrimoniales de resguardo y conservación; parte de estos vacíos incluyen el concepto de “presunción” y la propiedad privada del patrimonio (Echevarría 2008). Adicionalmente desde el 2007 nuevas leyes se han sumado poniendo en peligro el patrimonio arqueológico, como la ley que pretende concesionar a particulares el patrimonio cultural del Perú (Ley 29164), o el Decreto Legislativo 1003 destinado a agilizar los trámites de ejecución de obras públicas.
Recientemente el Presidente del Perú ha expresado públicamente que las obras civiles pueden hacerse incluso sin realizar los trámites regulares de saneamiento legal (Nota de Prensa No 2021 del Palacio de Gobierno. Lima, 20/2/09), como por ejemplo la obtención de permisos municipales, del Colegio de Arquitectos del Perú, o del Instituto Nacional de Cultura (INC), existiendo una presión legal que liberaliza, mediante leyes a varios niveles administrativos, las responsabilidades del Estado con su patrimonio cultural, con la intención de enajenarlo o de destruirlo; el caso de Macusani –Corani es prácticamente la punta de un iceberg mayor que también incluye famosos monumentos arqueológicos con arte rupestre como Santo Domingo, Toro Muerto o Checta.
En este contexto la defensa de los sitios arqueológicos puede convertirse en verdaderas campañas, como la que se emprendió por ejemplo para salvar los geoglifos de Santo Domingo en el valle de Moche (Melissa Massat 2008, Corcuera y Echevarría 2008) y éste también puede ser el caso de Macusani – Corani. Desde hace varios años el arte rupestre de estos lugares en la provincia de Carabaya, Puno, Perú, se debate en un dilema de conservación severo puesto que el área arqueológica que comprende se encuentra sobre una zona con extensas reservas de uranio cuya exploración sistemática, al menos desde el año 2001, habría generado una verdadera fiebre local por su obtención (Peralta 2008); lo que daría origen a los principales problemas actuales de conservación del arte rupestre y en general de todo el complejo arqueológico que esta zona implica.
Hasta recientemente, no obstante, la situación del arte rupestre y otros materiales arqueológicos asociados en Macusani - Corani, ya reconocidos desde comienzos de siglo XX, se han visto alterados negativamente por las condiciones favorables del gobierno peruano, desde el 2005 principalmente, para la inversión y explotación minera, que se amparan en una normatividad de trámite administrativo, facilitador y permisivo a estas industrias. Aunque la explotación minera parece ser inminente, los atenuantes a esta actividad incluyen aspectos sociales como el comportamiento de la población local (Peralta ob cit), y aspectos culturales asociados, especialmente la presencia del arte rupestre de la zona. En el año 2005 el Instituto Nacional de Cultural (INC) declaró a las pinturas de Corani y Macusani como Patrimonio Cultural de la Nación con lo cual se ha iniciado, legalmente, una pugna por la defensa y protección de estos yacimientos arqueológicos, lo que también ha generado campañas mediáticas como la que estamos comentando.
En orden de establecer parámetros mínimos para la comprensión del tratamiento de los bienes arqueológicos peruanos, como el arte rupestre, que ayuden además a entender la problemática de estos sitios, voy a examinar los aspectos más relevantes de la protección legal del patrimonio arqueológico que involucra directamente este caso.
La declaratoria de “Patrimonio Cultural de la Nación” de las pinturas rupestres de Corani y Macusani hecha por el Instituto Nacional de Cultura (INC) fue emitida en diciembre del año 2005 por Resolución Directoral Nacional No 1658 y publicada en el Diario Oficial “El Peruano”. La declaratoria de “Patrimonio Cultural” o “Monumento Arqueológico”, que es el tipo regular de resolución emitida en este caso, es, en general, un procedimiento sencillo que sólo requiere de una ficha de información, fotos, referencias y la supervisión y evaluación técnica de campo de un arqueólogo. La declaratoria, no obstante, sólo establece un estatus legal de protección nominal y no establece la protección definitiva del sitio arqueológico, que debe hacerse todavía mediante la declaratoria de un “área intangible”, es decir, mediante la delimitación física del área arqueológica declarada patrimonio.
La declaratoria de área intangible, que aún no existe para la zona de Macusani – Corani, es un paso crucial para la defensa de los sitios arqueológicos peruanos porque establece definitivamente la separación de áreas con usos diferenciados mediante la colocación de hitos contundentes, identificando el patrimonio cultural que de esta forma no puede ser violado. La delimitación física y señalización es tan importante que si no se realiza, el Estado generalmente no puede defender el patrimonio frente a destrucciones o saqueos, cuando aquellos que lo destruyen o saquean arguyen desconocimiento del área patrimonial; incluso cuando ésta ha sido declarada “Monumento Arqueológico” o “Patrimonio Cultural de la Nación”.
No obstante, este procedimiento es el más engorroso y difícil de realizar puesto que implica un alto costo, un extendido trámite burocrático y la realización de un expediente técnico; expediente que debe incluir un proyecto aprobado de delimitación arqueológica, la elaboración de planos de área efectiva (topográficos y perimétricos georeferenciados con equipo GPS diferencial), una ficha técnica y una memoria descriptiva, a lo que se suma la realización de excavaciones de descarte para el establecimiento físico de la poligonal del área y la colocación definitiva de los hitos. Todo este trabajo debe ser dirigido y supervisado por un arqueólogo que designa el INC, mediante una Resolución Directoral publicada en el Diario Oficial “El Peruano”. Adicionalmente esta zona debe ser inscrita en los Registros Públicos como una propiedad estatal, incluyendo las coordenadas revalidadas y geodésicamente alineadas con los puntos geográficos oficiales del Instituto Geográfico Nacional (IGN).
En el Perú sólo un arqueólogo capacitado legalmente (un profesional reconocido por el INC) puede dar fe, mediante un informe técnico, de la existencia y características de un bien arqueológico para fines de valor legal; nadie puede proponer la declaración de un patrimonio cultural arqueológico, y menos la delimitación física de un sitio arqueológico si esta propuesta no se encuentra basada en observaciones sistemáticas de un arqueólogo profesional, inscrito en el Registro Nacional de Arqueólogos del Perú, y perteneciente al Colegio de Arqueólogos del Perú; y ésta es una normatividad incuestionable. Como es evidente existe una extensa cadena de acciones antes de considerar a un sitio arqueológico protegido íntegramente, y el caso de Macusani - Corani recién se encuentra en una etapa inicial de este proceso.
Vista esta regulación vale la pena comentar ahora dos reportes sobre el problema de Macusani - Corani publicados por el Ingeniero Rainer Hostnig (Hostnig 2008a, 2008b), quien detalla una intensa campaña para salvar estos sitios de la explotación minera que se cierne sobre ellos. Ambos reportes son muy similares y se centran en muchos aspectos relacionados al tratamiento de bienes culturales y referencias normativas, lamentablemente muchas de las afirmaciones vertidas al respecto no son precisas y generan perspectivas erróneas respecto de la problemática de estos sitios y su intervención proteccionista, por lo que es importante aclarar algunas de estas afirmaciones para una mejor apreciación externa de los problemas que afectan al arte rupestre peruano.
Preliminarmente, debemos precisar que dado el extraordinario valor arqueológico de estas pinturas no es sorprendente que estas zonas haya sido declaradas patrimonio cultural mediante un aval arqueológico del INC. No obstante, resaltan sobre manera las afirmaciones iniciales del Ingeniero Hostnig respecto al tratamiento de este patrimonio cultural, argumentando haber “explorado sistemáticamente” entre el año 2000 y 2004 esas zonas arqueológicas y llevado a cabo, bajo cuenta del Gobierno Regional de Puno y del Gobierno Regional de Carabaya, una “exploración final” del arte rupestre para “localizar y registrar sitios, en áreas no cubiertas por [sus] previas prospecciones” (traducción mía, Hostnig 2008a: 231, Cf. Hostnig 2008b: 48); lo que según el autor le ayudó a diseñar una “propuesta de delimitación” del área.
Estas afirmaciones son insostenibles por varias razones, en primer lugar, porque nadie puede efectuar exploraciones sistemáticas o prospecciones bajo cuenta de ninguna institución sin el permiso y autorización expresa del Instituto Nacional de Cultura (INC), previa evaluación del proyecto por parte de la Comisión Técnica Nacional de Arqueología. Un trabajo de este tipo debe enmarcarse en un Proyecto Arqueológico aprobado por el INC que incluya el reconocimiento sistemático de esa evidencia; proyecto que de acuerdo al Art. 7 del Reglamento del Investigaciones Arqueológicas (Resolución Suprema No 004-2000- ED) permitiría localizar y registrar los sitios con arte rupestre de la zona. Este mismo Reglamento especifica la obligatoriedad de la autorización del INC para efectuar estas actividades, estableciendo que únicamente podrán dirigir estos proyectos en el Perú “Los particulares, nacionales o extranjeros, que posean preparación científica acreditada con títulos o grados en arqueología e inscritos en el Registro Nacional de Arqueólogos” (Art. 28, inciso b.).
En segundo lugar, el ingeniero Hostnig no puede, bajo ningún argumento, proponer una delimitación de un área arqueológica sobre la base de sus propias observaciones, porque carecen de valor legal para cualquier cuestión que implique al patrimonio cultural peruano. Esta persona cometió graves omisiones en este caso al no tomar en cuenta la autorización del INC, previa presentación y aprobación de un proyecto, y al excluir de entre sus colaboradores a arqueólogos capacitados en reconocer arte rupestre y otros materiales lo que hubiese dado un crédito inicial a sus observaciones, especialmente considerando que toda el área presenta otras evidencias arqueológicas entre monumentales y muebles (Cardenas 2008). Aunque en otra publicación el citado autor menciona que el 2007 lo acompañó “un arqueólogo del Proyecto Qhapaq Ñan del INC Puno” (Hostnig 2008b: 48), cuyo nombre evita mencionar, Hostnig deja muy en claro que es él, sin ninguna autorización, quién realiza las prospecciones y exploraciones en la zona, lo que la ley 29286 pena con sanciones administrativas y el Código Penal Peruano, en su artículo 226, tipifica como un delito.
Hasta aquí hay un procedimiento irregular evidente y una participación exclusivista en la exploración de la zona, lo que podría justificarse considerando, recién a partir del 2005, la inminente amenaza de destrucción de los yacimientos con arte rupestre; sin embargo otros aspectos de estos reportes son también incoherentes y ponen a consideración la tendencia del autor a relativizar la actuación de otros investigadores en estos sitios, y nos referimos específicamente a la participación del Proyecto de Investigación Arqueológica: “Inventario de Sitios Arqueológicos con Arte Rupestre en Macusani y Corani 2007 – 2008” dirigido por la arqueóloga peruana Patricia Vega Centeno.
En uno de sus reportes el Ing. Hostnig aprecia negativamente la aprobación oficial del Proyecto de Investigación de la Lic. Vega Centeno, que no favorece la ejecución de un catastro oficial de las pinturas de la zona (Hostnig 2008b:49), probablemente porque no toma en consideración que el INC carece de recursos para realizar catastros y en el mejor de los casos delimitaciones de áreas intangibles, lo que protegería los sitios más efectivamente. Desde el 2000 hasta el año 2006 el INC ha declarado en el Perú más de 4500 monumentos como Patrimonio Cultural de la Nación, pero son muy pocos los monumentos arqueológicos que cuentan con efectivas áreas protegidas. La aprobación por parte del INC del Proyecto de Inventario de esta arqueóloga peruana, con experiencia en estudios de arte rupestre, constituyó en el año 2007 el más afortunado acontecimiento histórico en la documentación técnica del arte rupestre de Puno y sin duda de la historia de los estudios rupestres peruanos, y por lo tanto un paso transcendental para la protección de estos sitios.
Un Proyecto de Investigación Arqueológica, (que es muy diferente a un Proyecto de Evaluación, un Proyecto de Emergencia, o a un Proyecto de Salvatage, Art. 6 del Reglamento de Investigaciones Arqueológicas) se basa fundamentalmente en una premisa intelectual de base científica, búsqueda de conocimiento, y en la explícita propuesta metodológica para abordar dicha búsqueda; de lo contrario no sería aprobado por el INC, y éste es uno de los aspectos más resaltantes de esta intervención. En la investigación dirigida por Vega Centeno participaron 19 arqueólogos de cinco universidades peruanas, teniendo como asesores a experimentados arqueólogos en el tema rupestre, logrando documentar más de 200 sitios arqueológicos con arte rupestre, además de otros sitios monumentales y superficiales asociados en un área de más de 70 mil hectáreas (Cárdenas 2008); lo que no tiene precedente en la investigación arqueológica peruana.
No obstante esto, las afirmaciones del ingeniero Hostnig contra este proyecto son suspicaces. Por ejemplo dicho autor afirma que el inventario realizado por la Arqueóloga Vega Centeno se basó en una documentación con “información detallada” que el INC “no había dudado en entregarle” para realizar su trabajo (Traducción mía. Hostnig 1998a: 232); sin embargo, en su siguiente publicación afirma que esta arqueóloga “Valiéndose de sus buenos contactos con la Dirección de Arqueología del INC Lima, (…) parece haber conseguido acceso al expediente con información georeferenciada de los sitios que yó [Hostnig] había entregado al INC – Lima en 2005…” (Hostnig 2008b: 49). ¿Por qué existe una contradicción entre las afirmaciones de Hostnig respecto al uso de su supuesta “información detalla” (2008a) o “información georeferenciada” (2008b)? En comunicación con la referida arqueóloga ella afirma no conocer dicho “expediente”, e incluso duda de su existencia pues en trabajos previos en archivos del INC no encontró referencias a dicho documento (Vega Centeno, Comunicación Personal 2009).
Por otra parte, el ingeniero Hostnig afirma que su financiada “exploración” en Macusani y Corani del 2007 le permitió “en cinco días de prospección intensiva” incorporar 18 nuevos sitios al “inventario” que le sirvió para elaborar la propuesta de delimitación del área (Hostnig 2008a: 231), sosteniendo que, dado que él nunca tuvo acceso al inventario del proyecto de Vega Centeno, no sabe cuáles sitios coinciden con el “inventario previo” o cuáles sitios son nuevos. Es obvio que este autor sugiere que él realizó un “inventario” de sitios con arte rupestre previo al trabajo del proyecto oficial de inventario, y esta es otra afirmación tendenciosa. Aparte del trabajo de Vega Centeno no existe ningún “inventario” de arte rupestre de Macusani - Corani y cualquier información relacionada, desarrollada por este autor o por cualquier otra persona, no constituyen más que listas de sitios. Hostnig claramente confunde el concepto de Inventario con el de relación o lista, y eso es evidente, por ejemplo, en su publicación del 2003 titulada “Inventario Nacional”, donde sólo para el departamento de Puno se realiza el inventario de 27 sitios “no localizados”, es decir, inexistentes.
El “Inventario Nacional” de arte rupestre peruano (Hostnig 2003) cita 79 sitios con arte rupestre para todo el departamento de Puno, además de los 27 sitios “no localizados”, y sin embargo Hostnig cuestiona la cuenta de Vega Centeno que alcanza el número de 200 sitios sólo para Macusani-Corani. En una publicación anterior este autor dice haber registrado y documentado “un centenar” de “estaciones rupestres” (Hostnig 2003: 17) que es la cuenta genérica que se podría estimar de él, puesto que en sus últimos reportes (2008a, 2008b) el máximo número citado de sitios es dieciocho; de cualquier forma es claro que Hostnig confunde “estaciones” con “sitios”, y eso prueba una vez más, aparte de su carencia metodológica, que sus afirmaciones no son confiables.
El hecho evidente es que Hostnig nunca puso a disposición de la arqueóloga Vega Centeno su expediente con “información detalla”, y critica la única intervención académica y profesional autorizada por el Estado en la zona. Es claro que este autor trata de desprestigiar, especialmente en su reporte en español (2008b), las únicas pruebas legales que pueden usarse para comprobar la existencia de los sitios con arte rupestre en caso de un juicio por la defensa o protección de estos mismos sitios. Aunque se afirme lo contrario, la ley establece que el informe de la arqueóloga Vega Centeno tiene carácter de dominio público a partir de un año después de su entrega al INC (Reglamento de Investigaciones Arqueológicas Ar. 59 inciso j), lo cual se da independientemente de los deseos de la compañía que financió estos estudios, para sus propios fines o no.
Es importante recalcar que el informe de Vega Centeno es en la actualidad la información más confiable, y probablemente la única, sobre los sitios arqueológicos de la zona, además del arte rupestre, que puede ser usada para fines legales, ya sea de catastro o delimitación arqueológica. Por primera vez el INC, a partir de este proyecto, puede estimar el valor cultural de los yacimientos arqueológicos de Macusani-Corani lo que sería una base oficial primaria para la protección de los sitios; a esto se puede sumar, en caso se realicen, los Proyectos de Evaluación Arqueológica para la emisión de Certificados de Inexistencia de Restos Arqueológicos (CIRA), que se realizan antes de la ejecución de obras públicas o privadas. El CIRA no puede emitirse sin un “Proyecto de Evaluación”, el cual puede, y en este caso específico debe, incluir excavaciones arqueológicas. No es verdad que el CIRA sólo constate “la no existencia de restos arqueológicos en superficie” como afirma Hostnig (Traducción mía. 2008a: 232, 2008b: 48), lo cual se encuentra establecido por Ley (Reglamento de Investigaciones Arqueológicas Art. 8 y Art 65). Los CIRAs, además, implican obligaciones como la necesidad de monitoreo y reportes al INC si encuentran evidencias arqueológicas durante la ejecución de las obras.
En la actualidad las condiciones políticas y legales del Perú hacen difícil la protección real de todos los sitios arqueológicos peruanos, y muchos arqueólogos están luchando con sus propios medios para defender el patrimonio cultural del Perú, siguiendo las reglas de juego que establecen las normas legales vigentes y sin interferir mutuamente los esfuerzos y logros alcanzados. Si bien es cierto, el Estado aún está lejos de asumir íntegramente la defensa del patrimonio arqueológico, existen esfuerzos institucionales y personales que se acercan a dicha misión (Gordillo, 2001: 49). En ese contexto el esfuerzo del ingeniero Hostnig es notable al llamar la atención internacional sobre estas reliquias ancestrales peruanas, pero no puede bajo ninguna circunstancia minimizar el trabajo arqueológico nacional, especialmente de un proyecto que significó la oportunidad dorada para salvar estos sitios y que ahora aparece internacionalmente como un obstáculo a los esfuerzos de este autor. Hostnig ha cometido actos tipificados como ilegales y ha publicado falacias en nombre de salvar una zona arqueológica sin tomar en cuenta a los arqueólogos peruanos ni apoyar y valorar sus esfuerzos.
Si nosotros dejamos de comentar este tipo de reportes estaríamos avalando ciertamente, a nivel internacional, el hecho de que cualquier persona aficionada al arte rupestre (una evidencia arqueológica oficialmente reconocida por las leyes peruanas) pueda intervenir, explorar, o prospectar sitios arqueológicos con arte rupestre de la manera más impune. Esto no es posible. Actividades a todas luces subrepticias, como las “exploraciones sistemáticas” que el ingeniero Hostnig dice haber llevado a cabo entre el año 2000 al 2004, están causando serios problemas de conservación en los sitios con arte rupestre en todo el Perú, sitios que siempre incluyen otros materiales arqueológicos asociados que el empirista no pueden reconocer. El ejemplo de intervención de este autor, expuesto claramente en sus propios reportes, es un mal precedente para los estudios rupestres peruanos que deben avanzar con premisas metodológicas claras, con programas más técnicos y científicos y sobre todo con la formalidad que exige el Estado Peruano.
Todos aquellos investigadores que deseen estudiar el patrimonio cultural peruano pueden hacerlo siguiendo las normas legales establecidas y respetando los campos de acción profesional respectivos. Adicionalmente existen Códigos de Ética internacionales (IFRAO 2000), y el en Perú el propio Código de Ética de APAR (2007) establece ciertos parámetros mínimos para la visita a sitios con arte rupestre. En la actualidad no existe ninguna excusa para la intervención subrepticia en los sitios arqueológicos con o sin arte rupestre peruanos y los arqueólogos de hoy están progresando mucho en la aproximación técnica a los sitios con este material cultural. El acatamiento de las normas legales y el trabajo coordinado con los arqueólogos y las instituciones que amparan el patrimonio nacional (INC) es una garantía mínima para la protección y conservación de estas preciadas reliquias arqueológicas del Perú, y todos debemos ser conscientes de esta realidad.
Apoyamos la campaña por la defensa y protección de los sitios con arte rupestre en Macusani y Corani, y esperamos que se den los pasos legales apropiados para su salvaguarda definitiva, a favor de las comunidades nativas y de toda la nación peruana.

Peruvian rock art, some comments about the Macusani – Corani case[1].

The conservation of the archaeological sites in Peru, especially of the rock art sites, struggles today in a general crisis. Sites as those of Macusani - Corani fight for its survival mainly because the legal regulation that observes the Peruvian archaeological sites is structurally weak to protect them. The main law that states the legal situation of the Peruvian cultural patrimony, the Ley General de Patrimonio Cultural de la Nación (Law 29286,) exhibits for example serious legal emptiness that surreptitiously generate problems of patrimonial defense and conservation; part of these emptiness include the concept of "presumption" and the private property of the patrimony (Echevarría 2008). Additionally since 2007 new laws came in to increase the danger to the archaeological patrimony, like the law that wants to put on concession to privates or individuals persons the Cultural Patrimony (Law 29164,) or the Legislative Decree 1003 destined to speed up the proceedings of public work execution.
The President of Peru has recently expressed that the public works can even be made without making the normal procedures of legal regulation (Press Note No. 2021 of the Palace of Government. Lima, 20/2/09,) as the obtaining permissions form the local municipalities, or from the “Colegio” of Peruvians Architects, or from the National Institute of Culture (INC,) existing a legal pressure that liberalizes, by laws at several administrative levels, the responsibilities of the State with its cultural patrimony with the intention of alienating it or to destroying it. The Macusani - Corani case is just the tip end of an iceberg than also includes famous archaeological monuments with rock art as “Santo Domingo”, “Toro Muerto” or “Checta.”
In this context the defense of the archaeological sites can become true campaigns, as the campaign undertaken to save the geoglyphs of Santo Domingo in the Moche valley (Melissa Massat 2008, Corcuera and Echevarría 2008) and this also can be the Macusani - Corani case. For several years the rock art of these zones in the province of Carabaya, Puno, Peru, have been debated in a severe dilemma of conservation since its mayor archaeological area are find on a zone with extensive uranium reserves whose systematic exploration, at least from year 2001, would have generated a true local fever by its obtaining (Peralta 2008;) what would give origin to the main actual problems of rock art conservation and for all the archaeological complex that this zone implies.
Until recently, however, the situation of the rock art and other associated archaeological materials in Macusani - Corani, already recognized from beginnings of 20th century, has been altered negatively by the favorable conditions of Peruvian government, since 2005 principally, for the investment and mining operation protected by a suitable legislation to these industries. Although the mining operation seems to be imminent, the inappropriate conditions to this activity include social aspects like the local population behavior (Peralta ob cit,) and other cultural aspects, especially the presence of rock art in the zone. In the year 2005 the National Institute of Culture (INC) declared to the Corani and Macusani paintings as National Cultural Patrimony with which it has begun, legally, a struggle by the defense and protection of these archaeological sites, which also has generated media campaigns like the one we are commenting.
In order of establish minimum parameters to understand the treatment of the Peruvian archaeological goods like the rock art that help to understand the problems of these sites, I am going to examine the most relevant aspects of the legal protection of the archaeological patrimony that involves directly this case.
The declaratory of "National Cultural Patrimony" of the rock paintings of Corani and Macusani done by the National Culture Institute (INC) was emitted on December of year 2005 by National Resolution No. 1658 and published in the official Newspaper “El Peruano”. The declaration of “Cultural Patrimony” or “Archaeological Monument,” that is the regular type of resolution emitted in this case, is in general a simple procedure that only requires an information formulary, photos, references and the field supervision and technical evaluation of an archaeologist. The declaration, however, only establish a legal situation of nominal protection and it does not establish the definitive protection of the archaeological site, that must still be made by means of the declaration of an “intangible area,” that is to say, by means of the physical delimitation of the archaeological zone declared patrimony.
The declaratory of intangible area that not yet exist for the Macusani - Corani zone, is a crucial step for the defense of the Peruvian archaeological sites because establishes definitively the separation of areas with distinct uses by the placing of physical landmarks identifying the cultural patrimony that in this way can not be violated. The physical delimitation is so important that if it is not made, the State can not defend the patrimony against destructions or lootings, when those who destroy it or loot it argue ignorance of the patrimonial area; even when this area has been declared “Archaeological Monument” or “National Cultural Patrimony”.
Nevertheless that, this procedure is the most troublesome and difficult to make since it implies a high cost, an extended bureaucratic proceeding and the accomplishment of a technician dossier; dossier that must include an approved project of archaeological delimitation, the elaboration of area plans (topographic and perimetrical geo-referenced with differential GPS equipment,) a specification sheet, and a descriptive memory, to which we must adds the excavation of pit test for the physical establishment of polygonal of the area and the definitive location of the landmarks. All this work must be directed and supervised by a competent archaeologist and approved by the INC by means of a National Resolution published in the Official Newspaper “El Peruano.” Additionally this zone must be registered in the Office of Public Records like a state property including its validated coordinates, geophysical aligned with the official geographic points of the Geographic National Institute (IGN).
In Peru only an archaeologist legally qualified (a professional recognized by the INC) can assert, by means of a technical report, of the existence and characteristics of an archaeological good for aims of legal value; nobody can propose the declaration of an archaeological cultural patrimony and even less the physical delimitation of an archaeological site if this proposal is not based on systematic observations of a professional archaeologist enlisted in the National Register of Peruvian Archaeologists and associate to the “Colegio” of Peruvian Archaeologists; and this is an unquestionable regulation. As it is evident an extensive chain of action exists before considering an archaeological site fully protected, and the Macusani - Corani case is just in an initial stage of this process.
Based on this regulation I’m about to comment two reports on the of Corani -Macusani problem published by the engineer Rainer Hostnig (Hostnig 2008a, 2008b) who details an intense campaign to save these sites from the menace of mining exploitation. Both reports are very similar and they are centered on several aspects related to the treatment of cultural goods and normative references, lamentably some of the affirmation on the matter are not precise and generate wrong perspectives regarding to the problematic of the sites and its protectionist intervention, reason why it is important to clarify some of this affirmations for a better external appreciation about the problems that affect the Peruvian rock art.
Preliminarily we have to precise that given the extraordinary archaeological value of these paintings is not surprising that these sites has been declared cultural patrimony by means of an archeological endorsement of the INC. Nevertheless, the initial affirmation of the engineer Hostnig stand up with respect to the treatment of this cultural patrimony arguing have been “explored systematically” between the years 2000 and 2004 those archaeological zones and to have carry out, sponsored by the Regional Government of Puno and the Provincial Government of Carabaya, a “final rock art exploration” to “locate and register sites in areas not covered by my [his] previous surveys” (Hostnig 2008a: 231, Cf. Hostnig 2008b: 48); what according to the author helped him to design a “delimitation proposal” of the area.
These assertions are unsustainable by several reasons, first because nobody can carry out systematic explorations or surveys under the account of any institution without the express permission and authorization of the National Culture Institution (INC), previous evaluation of the Project for the National Technical Commission of Archeology. A work of this type must be framed in an Archaeological Project approved by the INC that includes the systematic recognition of that evidence; project that according to the Art. 7 of the “Regulation of Archaeological Investigations” (Supreme Resolution 004-2000- ED) would allow the location and registry of sites with rock art of the zone. This same regulation specifies the obligatory mandate of the INC authorization to effect these activities, establishing that only will be able to direct these projects in the Peru “The individuals, nationals or foreigners, who have scientific preparation credited with titles or grades in archaeology and enlisted in the National Register of Archaeologists” (Art. 28, b. my translation.)
Secondly, the engineer Hostnig cannot, under any argument, propose a delimitation of an archaeological area on the base of his own observations, because they lack legal value for any question that implicates the Peruvian cultural patrimony. This person committed serious omissions in this case when not taken into account the INC authorization, previous presentation and approbation of a project, and when he excluded from between his collaborators qualified archaeologists enabled in recognizing rock art and other materials which had given an initial credit to his observations, especially considering that all the area presents other archaeological evidences between monumental and movable (Cardenas 2008.) Although in other publication this author says that in 2007 “an archaeologist from the Capaq Ñam Project of the INC Puno” accompanied him (Hostnig 2008b: 48. My translation,) whose name avoids to mention, Hostnig establish very clear that it is him, without no authorization, who makes the surveys and explorations, which the Peruvian Criminal Code, in its article 226, categorizes like a crime.
Up to here there is an evident irregular procedure and an exclusivist participation in the exploration of the zone, which could be justified considering, from the year 2005, the imminent menace of destruction of the rock art sites; nevertheless other aspects of the reports are also incoherent and put to consideration the tendency of this author to minimizes the performance of other investigators in these sites, and we refer specifically to the Project of Archaeological Investigation: “Inventory of Archaeological Sites with Rock Art in Macusani and Corani 2007 – 2008” directed by the Peruvian archaeologist Patricia Vega Centeno.
In one of his reports Hostnig negatively appreciates the official approval of the Investigation Project of Vega Centeno, that does not favor the execution of a cadastre of the paintings (Hostnig 2008b:49,) probably because he does not take in consideration that the INC lacks resources to make cadastres and in the best of the cases delimitations of intangibles areas what would protect the sites more efficiently. From the year 2000 to year 2006 the INC has declared in Peru more than 4500 monuments as National Cultural Patrimony but very few archaeological monuments count with effective protected areas. The INC’s approbation of the Inventory Project of this archaeologist, with experience in rock art studies, constituted in the year 2007 the more fortunate historical event in the technical documentation of the rock art of Puno and without a doubt in the history of the Peruvian rock art studies, and therefore a transcendental step for the protection of these sites.
A Project of Archaeological Investigation (which is very different from to an Evaluation Project, or an Emergency Project, or an Rescue Project, Art. 6 of the Regulations of Archaeological Investigations) are based fundamentally on a scientific premise, search of knowledge, and in the explicit methodological proposal to approach this search; otherwise it would not be approved by the INC, and this is one of the most standing out aspects of this intervention. In the investigation directed by Vega Centeno nineteen archaeologists from five Peruvian universities participated, managing to document more than 200 archaeological sites with rock art besides other monumental and superficial sites associates in an area of more than 70 thousand hectares (Cardenas 2008); what it does not have precedent in the Peruvian archaeological investigation.
Despise this; the affirmations of the engineer Hostnig against this project are suspicious. For example this author states that the inventory made by the Archaeologist Vega Centeno are based on a documentation with “detailed information” that the “INC officials did not hesitated to furnish her” to make her work (Hostnig 1998: 232); however, in his following publication he affirms that this archaeologist "using her good contacts with the Office of Archaeology of the INC - Lima, (…) seems to have obtained access to the dossier with geo-referenced information about the sites that I [Hostnig] had given to the INC – Lima in 2005 …" (Hostnig 2008b: 49. My translation) Why exists a contradiction between the affirmations of Hostnig regarding to the use of his supposed “detailed information” (2008a) or “geo-referenced information” (2008b)? In communication with the referred archaeologist she affirms not knowing this “dossier”, and even she questions its existence since in previous works in the archives of the INC she did not find any references to this document (Vega Centeno, Personal Communication 2009.)
On the other hand, the engineer Hostnig states that his sponsored “exploration” in Macusani and Corani of 2007 allowed him “in five days of intensive survey” to add eighteen new places to the “inventory” that served him to elaborating his delimitation proposal (Hostnig 2008a: 231,) arguing that, since he never had access to Vega Centeno’s inventory, he does not know which sites coincide with the “previous inventory” or which sites are new. It is obvious that this author suggests that he made a rock art sites “inventory” before the work of the official project of inventory, and this is another tendentious affirmation. Asides Vega Centeno’s work any rock art “inventory” of Macusani – Corani does not exist, and any related information developed by this author or by any other person does not constitute more than a lists of sites. Hostnig clearly confuses the “inventory” concept with the one of “relation” or “list,” and that is evident, for example, in his 2003 publication entitled “National Inventory”, where only for the department of Puno he realized the “inventory” of twenty seven “not located sites”, that is to say, nonexistent sites.
The “National Inventory” of Peruvian rock art (Hostnig 2003) mentions seventy nine sites with rock art for all the department of Puno, in addition to the twenty seven “not localized” sites, and nevertheless Hostnig questions the count of Vega Centeno that reaches the number of 200 sites only for Macusani - Corani. In a previous publication this author says to have registered and documented “a hundred” of “rupestrial stations” (Hostnig 2003: 17) which is the generic count that could be considered of him, since in his last reports (2008a, 2008b) the maximum mentioned number of sites is eighteen; anyway it is clear that Hostnig confuses “stations” with “sites,” and that proves once more, besides his methodological deficiency, that his affirmations are not reliable.
The evident fact is that Hostnig never made available to the archaeologist Vega Centeno his dossier with “detailed information,” and criticizes the unique academic and professional intervention authorized by the State in the zone. It is clear that this author try to discredit, especially in his Spanish report (2008b,) the only legal proofs that can be used to verify the existence of the sites with rock art in case of a trial for the defense or protection of those sites. Although the opposite can be say, the law estates that the report of the archaeologist Vega Centeno has character of public domain after one year of its delivery to the INC (Art. 59, j. Regulation of Archaeological Investigations,) which occurs independently of the desires of the company that financed these studies for its own aims or not.
It is important to stress that the Vega Centeno report is at present the most reliable information, and probably the only one, about the archaeological sites of the zone, besides the rock art, that can be used for legal aims, cadastre or archaeological delimitation. For the first time the INC, from this project, can estimate the cultural value of Macusani - Corani archaeological deposits which would be a primary official base for the protection of the sites; and it is possible to add in case are carried out, the Projects of Archaeological Evaluation for the emission of the “Certificate of Nonexistence of Archaeological Remains” (CIRA,) that is made before any public or private work execution. The CIRA can not be issue without an “Evaluation Project,” which can, and in this specific case must, include archaeological excavations. It is not true that the CIRA “only states that on the surface of a specific area no archaeological remains exist” as affirm Hostnig (2008a: 232, 2008b: 48) which are established by Law (Art. 8 and Art 65 Regulation of Archaeological Investigation.). The CIRA in addition implies obligations like the need of monitoring and reports to the INC if archaeological evidence were find during the execution of the work.
At the present time the political and legal conditions of Peru make difficult the real protection of all the Peruvian archaeological sites and many archaeologists are fighting with their own means to defend the cultural patrimony of Peru following the “game rules” that establish the valid legal norms and without interfering the efforts and achievements reached mutually. Although it is true than the State is still far from assume integrally the defense of the archeological patrimony, personal and institutional efforts exist that approach to that mission (Gordillo 2001: 49). The effort of the engineer Hostnig is remarkable when calling the international attention on these Peruvian ancestral relics, but he cannot, under any circumstance, diminish the national archaeological work, especially of a project that meant the golden opportunity for saving these sites and that today appears internationally like an obstacle to the efforts of this author. Hostnig has committed illegal acts and has published fallacies in name of saving an archaeological zone without taking in consideration the Peruvian archaeologists nor to support its efforts.
If we did not commenting this kind of reports we would be accepting certainly, at international level, the fact that any person interesting on rock art (an archaeological evidence officially recognized by Peruvian laws) can explore, survey or remove archaeological sites with rock art in the most unpunished way. This is not possible. Surreptitious activities like the “systematic explorations” that the engineer Hostnig says to have carry out between year 2000 to 2004 are causing serious problems of conservation in the sites with rock art in all Peru, sites that always include other archaeological materials associates that these empirics persons cannot recognize. The example of intervention of this author, exposed clearly in his own reports, is a bad preceding for the Peruvian rock studies that must advance with clear methodological premises and with more technical and scientists programs and overall with the formality that the Peruvian State demands.
All those researchers that want to study the Peruvian cultural patrimony can do it following the established legal proceedings and respecting the respective professional field areas. Additionally exist an International Code of Ethics (IFRAO 2000) and in Peru the own APAR’s Code of Ethics (2007) establishes certain minimum parameters for the visit to rock art sites. At present there are not excuses for the surreptitious interventions in the Peruvian archaeological sites with or without rock art, and today the Peruvians archaeologists are progressing in the technical approach to the sites with this cultural material. The observance of the legal norms and the coordinate work with the archaeologists and the institutions that protect the national patrimony (INC) is a minimum guarantee for the protection and conservation of this archaeological relic, and all we must be conscious of this reality.
We support the campaign by the defense and protection of the sites with rock art in Macusani and Corani, and we hope that the appropriate legal steps for its definitive safeguard occur, in behalf of the native communities and of all the Peruvian nation.
