2.6 Overtime Status

Human Resources will classify an employee as either exempt or non-exempt according to the guidelines defined in federal and state wage and hour laws.

2.6.1 Exempt

An exempt employee’s job responsibilities allow her/him to be exempt from the overtime provisions of the Kentucky Wage and Hour Law. An exempt employee is not eligible to receive overtime pay. During public health emergency situations, exempt employees may be able to receive compensatory time. (See Compensatory Time During Public Health Emergencies for details.)

Pay for an exempt employee is expressed in terms of a weekly salary which is determined by multiplying a pre-established hourly rate by the number of hours in a standard workweek (40 hours for a full-time employee (see section 2.3.) Salary payment amount shall be adjusted by such circumstances as an employee being hired or terminated mid-week, a promotion, demotion, reclassification, raise, salary re-alignment, or other necessary adjustment.

2.6.2 Non-Exempt

A non-exempt employee is not exempt from the overtime provisions of the Kentucky Wage and Hour Law and is therefore eligible to receive overtime pay.

The salary for a non-exempt employee is calculated and expressed using an hourly basis method.
