2.12 Medical Examinations

An employee must submit to any medical examination required by NKY Health for business purposes. The employee will be told the reason for the examination.

2.12.1 Tuberculosis Test / TB Test

As a condition of employment, an employee must pass a medical examination which may include a skin test for tuberculosis depending upon her/his associated risk. An employee who tests positive for TB must comply with the directives of the District Director of Health and/or her/his designee for further evaluation and treatment of the TB infection.

Any employee who fails to comply may be subject to appropriate disciplinary action (see section 7.4), up to and including dismissal (see section 8.4.)

2.12.2 Fitness for Duty Examination

When, in the opinion of the District Director of Health and/or her/his designee, there exists evidence that an employee is no longer able to perform satisfactorily her/his assigned duties due to health problems or when the employee poses a health threat to clients or other employees, the District Director of Health and/or her/his designee may require said employee to provide evidence of fitness-for-duty from a physician of NKY Health’s choosing. NKY Health will incur the cost of this examination.

2.12.3 Signed Consent for Medical Examinations

NKY Health reserves the right to disclose an employee’s medical condition to those in the chain of command if that condition may affect the employee’s ability to perform his job functions, or may impact the efficiency or operations of the department that the employee is working in. The District Director of Health and/or her/his designee will determine on a need-to-know basis which employees are entitled to access to medical information.
