Time in Lieu 

A per the VGSA 2022, Time in lieu can be claimed by both teaching and ES staff if they are required to attend for duties outside of regular working hours for scheduled 'school activities'. 


For teaching staff 

The VGSA2022, states:

“For the purposes of this clause “school activity” means a structured activity organised by the school such as a parent teacher meeting, camp, excursion, concert, parent information session or after-hours sport.

(8) (a)   (i)  Subject to clause 24(11) the Employer may require a teacher to attend a school activity outside the normal attendance of the teacher where such attendance is unavoidable and reasonable notice is provided.  A teacher may request not to attend the school activity outside the normal attendance of the teacher where this will unreasonably affect the teacher’s personal or family commitments. The Employer may only refuse the request on reasonable grounds.  All work required in excess of 38 hours per week for a full-time teacher (or on a pro-rata basis for a part time teacher) must be documented by the Employer.

(ii) Where duty required under subclause (8)(a) results in a teacher’s attendance in that week exceeding 38 hours for a full-time teacher or on a pro-rata basis for a part time teacher that teacher will be granted time-in-lieu for the hours in excess of 38 hours for a full-time teacher or the pro-rata hours of a part time teacher.

(iii) In respect of a teacher’s attendance at a school camp, the time-in-lieu will be calculated on the basis of 100% time in lieu for the time the teacher is performing duties, and 50% during the time the teacher is on call and available to perform duties.”

Time In Lieu (TiL) processes at Heathmont College will follow the VGSA guidelines and to support this process, each year a list of School Organised activities will be published along with an indication of the staff who will be required for each activity.


For all teachers, time in lieu must first be approved by the principal before it is accrued (prior to the additional hours being worked) and acquittal of the TiL will be conducted through negotiation between the individual staff member and the principal. There is a TiL application form that the staff member must complete for approval to be granted (available on the Staff Information Portal). Once approval is secured, staff members are to register their TiL on EduPay. The TiL application form will also outline the process for Acquittal of the leave and these details will be provided to the Daily Organiser and Director of Operations once the TiL application has been approved.  

 

Positions of Responsibility that carry an expectation of attendance in events that run outside of hours will have this clearly specified in their Position Descriptions prior to these positions being advertised. The specific arrangements for compensation for this attendance will also be documented in the Position Description.  

 

Time in Lieu for attendance at camp will be managed through consultation committee.

ES Staff 

For ES staff, it will be assumed that TIL is granted for time worked outside of normal hours if required for certain PDs like anaphylaxis etc. or duties such as supporting parent/teacher interviews. These will still require individual documentation but are deemed approved. These extra duties however can be compensated by reduced work hours on the day by negotiation.  For all other TIL, approval must be granted prior to the hours being worked.  Any ES staff who are required to attend during a vacation period will be paid the leave purchase allowance as per the TIL Policy and in line with The Agreement, clause 24(5).

 

In line with their employment mode the Director of Operations and Resources and Office Administrator will be in attendance in the week prior to the start of term as agreed.

o   Open to all students of a subject / year level / program (eg. Year level camps, leadership camps, Outdoor education camps, year 10 formal, valedictory)

o   Designed to enhance the educational opportunities for achievement for students (eg. Debating, other interschool competitions that occur outside of regular school hours and for which teachers are required)

o   To support the involvement of the wider community and families (parent meetings, parent teacher interviews, meet and greet events, subject information nights, community events)

Timing of acquittals

Where a teacher has accrued time in lieu, that time is to be acquitted at a time(s) that causes the least disruption to the educational program of the school. Where an education support class employee has accrued time in lieu, that time is to be acquitted at times following consideration of the operational needs of the school. 

Pay out of time in lieu, where it is used, will be restricted to small periods of time where it is neither convenient or appropriate for other means of acquittal to be actioned and all request for this will run through Consultative Committee.
