The Employer shall have the exclusive right to determine when a vacancy exists and if a transfer or reassignment is feasible. Vacancies shall be posted electronically. Employees must apply for a vacant position.
The Board shall have the sole authority to determine if a vacancy exists. No permanent vacancy or newly created job classification in the bargaining unit shall be filled by hire or promotion until such vacancy has been posted on bulletin boards with the description of the position to be filled and announced by email and telephone voicemail box for a period of five (5) calendar days and current employees have had the opportunity to apply for such position and have their written application considered before advertising the position publicly. No employee will be required to resign from a position when applying for another position.
The vacancy shall be filled by the applicant deemed most qualified. All factors of qualifications and competence being equal, seniority shall prevail and all internal applicants shall be notified when the position is filled. There shall be a probationary period of up to thirty (30) days in the new position, at which time the transfer is mutually evaluated. One of the factors to be considered as qualifications in the transfers of Bus Drivers on regularly assigned routes shall be the “Neighborhood Concept” of Bus Driver assignment.
