There are 2 types of Rest Periods:
Should either of these Scheduled Rest Periods be infringed, the time the break is cut short by is recompensed as per Overtime stipulation
This curtailment of the Scheduled Rest period Overtime is also given the shorthand of TOC
Every working day should be followed by an 11 hour daily rest break, before the start of your next shift. (see Core T&Cs Doc)
Example
Unit Wrap is called at 1900 Monday, with an individuals end of duty day at 2000 following derig
Daily Rest = 2000 + 11hrs = 0700 Tuesday
Earliest possible call without attracting additional fees = 0700 Tuesday
(note, 1 hour OT & 1.5T is applicable in this scenario)
See Calculating Infringements below, should the 11 hour break be compromised,
The schedule for each 7 day period should include 2 x scheduled rest day on Saturday & Sunday. (see Core T&Cs Doc)
Crew are entitled to an 11 hour daily rest period immediately prior to the scheduled 48 hour rest periods.
Put simply; between your end of shift on Friday and start of shift on Monday, you must take a minimum of 59 hours break.
Example
Unit Wrap at 1900 on Friday, with end of duty day at 2000 following derig
Daily rest = 2000 + 11hrs = 0700 Saturday
Weekly rest = 0700 + 48hrs = 0700 Monday
Earliest possible call without attracting additional fees = 0700 Monday
This pattern is often referred to as a 59hr break (11+24+24)
See Calculating Infringements below, should the scheduled break be compromised,
Put simply, if you do not get the breaks outlined in the sections above, you will be entitled to be compensated for the difference between minimum rest and actual rest.
Hours worked in breach of Daily & Weekly rest can only be worked in exceptional circumstances and must be agreed between the Worker and the Producer in advance. Such time will be paid in half hourly increments at T1.5 for the first hour, T2 for the second hour and T3 thereafter.
This in addition to any fees associated with work undertaken. (see Core T&Cs Doc)
Examples - Mid Week Daily Rest encroachment 10+1 SWD
End of Shift at 2100 Tuesday, 1 hr pre-call@ 0700 on an 0800 Unit Call on Wednesday
Daily Rest = 2100 + 11hrs = 0800 Wednesday (Earliest possible call without attracting additional fees)
Booked as: 1x 1hr TOC @1.5T (0700-0800) + 1hr OT @ 1.5T 0700 Precall (0700-0800)
Example - Weekend / Weekly Rest Encroachment
Unit Wrap at 2100 on Friday, with end of duty day at 2200 following derig, 1 hr pre-call@ 0700 on an 0800 Unit Call on Monday
Daily rest = 2200 + 11hrs = 0900 Saturday
Weekly Rest = 0900 + 48hrs = 0900 Monday (Earliest possible call without attracting additional fees)
Booked as: 1hr OT @ 1.5T (Fri 2100-2200)+ 2hrs TOC @ T2 (Mon 0700-0900) + 1hr OT @ 1.5T 0700 Precall (Mon 0700-0800)
The TV Drama Agreement doesn't use this term TOC, preferring the term "Scheduled Rest Periods" and explained in clause 6.8
Every working day should be followed by an 11 hour daily rest break, before the start of your next shift.
Example
Unit Wrap is called at 1900 Monday, with an individuals end of duty day at 2000 following derig
Daily Rest = 2000 + 11hrs = 0700 Tuesday
Earliest possible call without attracting additional fees = 0700 Tuesday
6.8.1 11 hours daily rest period: Workers should be given no less than 11 hours rest between the end of one work period and the commencement of the next.
Under the 2017 TVDA, the schedule for each 7 day period should include at least one scheduled rest day.
Crew are entitled to an 11 hour daily rest period immediately prior to any scheduled 24 or 48 hour rest periods.
Put simply;
1x designated/scheduled rest day is one 24hr period, following on from your personal daily (11hr)rest period.
These rest periods can be taken as singles (24) or double (48) patterns
Example - 1 day weekend
Wrap at 1900 on Friday, with end of duty day at 2000 following derig
Daily rest = 2000 + 11hrs = 0700 Saturday
Saturday Off = 0700 + 24hrs = 0700 Sunday
Earliest possible call without attracting additional fees = 0700 Sunday
This pattern is often referred to as a 35hr break (11+24)
6.8.2 Weekly rest: The schedule for each 7 day period should include at least one scheduled rest day. Workers shall be entitled to their 11 hour turnaround rest period immediately prior to any scheduled 24 or 48 hour rest periods. Rest days may be scheduled consecutively or separately.
If you do not get the breaks outlined in the sections above, you will be entitled to be compensated for the difference between scheduled rest and actual rest.
There are 2 methods of compensation:
Compensatory Rest.
Financial
Compensatory Rest, is also known as Time Off In Lieu (TOIL) where the time owed is paid back within the contracted day, the equivalent of 1T.
Financial compensation means you are paid a fee for the missed period of a break. This is paid as Overtime, equivalent to 1.5T.
Historically, TOC has been booked at the end of a shift, in full hours, however, under this agreement, we conceded to following the Overtime clause. This allows TOC to be booked as 2x 30 Min segments IF those segments have not been used for Pre-calls, shortened/missed meal breaks, derig, travel etc.
Example - Mid Week Daily Rest encroachment 10+1 SWD
Wrap at 2100 Monday, with no OT owing
Daily Rest = 2100 + 11hrs = 0800 Tuesday (Earliest possible call without attracting additional fees)
Tuesday duty hours are 0730 - 1900
Booked as:
Monday: 1x SWD (1000-2100 )+ 1x 30 OT/TOC (2100-0730, 30mins lost rest, billable as 1x 30 min segment)
Tuesday: 1x SWD (0730-1830) + 1x 30 OT (1830-1900)
Example - 1 day weekend
Wrap at 1900 on Friday, with end of duty day at 2000 following derig
Daily rest = 2000 + 11hrs = 0700 Saturday
Saturday Off = 0700 + 24hrs = 0700 Sunday
Earliest possible call without attracting additional fees = 0700 Sunday
This gives a 35 hour break between shifts, with any breach bookable as 2x 30 mins, then full hours, assigned to Friday
Example - 2 day weekend
Wrap at 1900 on Friday, with end of duty day at 2000 following derig
Daily rest = 2000 + 11hrs = 0700 Saturday
Saturday Off = 0700 + 24hrs = 0700 Sunday
Sunday Off = 0700 + 24hrs = 0700
Earliest possible call without attracting additional fees = 0700 Monday
his gives a 35 hour break between shifts, with any breach bookable as 2x 30 mins, then full hours, assigned to Friday
6.8.3 In the event a scheduled rest period is broken by the Producer, the Producer shall wherever possible allow the Worker to take an equivalent period of compensatory rest. Where this is not possible, time worked in breach of a scheduled rest period will be paid at the applicable overtime rate.
