In a case being dealt with by the International Court of Justice, the General Act for the Pacific Settlement of International Disputes of 26 September 1928 provides a basis of jurisdiction for the Court to entertain a unilateral application. Peaceful settlement of international disputes is a fundamental principle of international law of a peremptory character. It is formulated as such in the UN Charter (Article 2.3), and developed in UNGA Resolution 2625 (XXV) on Principles of International Law concerning Friendly Relations and Co-operation among States.
En un caso que está siendo manejado por la Corte Internacional de Justicia, el Acta General para el Arreglo Pacífico de Controversias Internacionales del 26 de septiembre de 1928 proporciona una base de competencia para que la Corte conozca de una solicitud unilateral. La solución pacífica de controversias internacionales es un principio fundamental del derecho internacional de carácter imperativo. Está formulado como tal en la Carta de la ONU (Artículo 2.3), y desarrollado en la Resolución 2625 (XXV) de la Asamblea General de las Naciones Unidas sobre los Principios del Derecho Internacional relativos a las Relaciones Amistosas y la Cooperación entre Estados.
CHAPTER 1: CONCILIATION
ARTICLE 1: Disputes of every kind between two or more Parties to the present General Act which it has not been possible to settle by diplomacy shall, subject to such reservations as may be made under Article 39, be submitted, under the conditions laid down in the present Chapter, to the procedure of conciliation.
CAPÍTULO 1: CONCILIACIÓN
ARTÍCULO 1: Las controversias de cualquier tipo entre dos o más Partes en la presente Acta General que no haya sido posible resolver por la vía diplomática se someterán, con sujeción a las reservas que puedan hacerse en virtud del artículo 39, en las condiciones establecidas en el presente Capítulo , al procedimiento de conciliación.
CHAPTER 2: JUDICIAL SETTLEMENT
ARTICLE 17: All disputes with regard to which the parties are in conflict as to their respective rights shall, subject to any reservations which may be made under Article 39, be submitted for decision to the Permanent Court of International Justice, unless the parties agree, in the manner hereinafter provided, to have resort to an arbitral tribunal.
ARTICLE 18: If the parties agree to submit the disputes mentioned in the preceding article to an arbitral tribunal, they shall draw up a special agreement in which they shall specify the subject of the dispute, the arbitrators selected, and the procedure to be followed...
ARTICLE 19: If the parties fail to agree concerning the special agreement referred to in the preceding article, or fail to appoint arbitrators, either party shall be at liberty, after giving three months' notice, to bring the dispute by an application direct before the Permanent Court of International Justice.
CAPÍTULO 2: ACUERDO JUDICIAL
ARTÍCULO 17: Todas las controversias respecto de las cuales las partes estén en conflicto en cuanto a sus respectivos derechos, sin perjuicio de las reservas que puedan formularse en virtud del artículo 39, se someterán a la decisión de la Corte Permanente de Justicia Internacional, a menos que las partes acuerden, en la forma prevista más adelante, a recurrir a un tribunal arbitral.
ARTÍCULO 18: Si las partes acuerdan someter a un tribunal arbitral las controversias a que se refiere el artículo anterior, harán un convenio especial en el que especificarán el objeto de la controversia, los árbitros elegidos y el procedimiento a seguir...
ARTÍCULO 19: Si las partes no se ponen de acuerdo sobre el convenio especial a que se refiere el artículo anterior, o no designan árbitros, cualquiera de las partes podrá, previo aviso de tres meses, llevar la controversia mediante una demanda directamente ante el Corte Permanente de Justicia Internacional.
CHAPTER 3: ARBITRATION
ARTICLE 21: Any dispute not of the kind referred to in Article 17 which does not, within the month following the termination of the work of the Conciliation Commission provided for in Chapter I, form the object of an agreement between the parties, shall, subject to such reservations as may be made under Article 39, be brought before an arbitral tribunal which, unless the parties otherwise agree, shall be constituted in the manner set out below.
ARTICLE 22: The Arbitral Tribunal shall consist of five members. The parties shall each nominate one member, who may be chosen from among their respective nationals. The two other arbitrators and the Chairman shall be chosen by common agreement from among the nationals of third Powers. They must be of different nationalities and must not be habitually resident in the territory nor be in the service of the parties.
CAPÍTULO 3: ARBITRAJE
ARTÍCULO 21: Toda controversia que no sea de las a que se refiere el artículo 17 y que, dentro del mes siguiente a la terminación de los trabajos de la Comisión de Conciliación prevista en el Capítulo I, no sea objeto de un acuerdo entre las partes, estará sujeta a a las reservas que puedan formularse en virtud del artículo 39, se someterá a un tribunal arbitral que, a menos que las partes acuerden otra cosa, se constituirá en la forma que se indica a continuación.
ARTÍCULO 22: El Tribunal Arbitral estará integrado por cinco miembros. Cada una de las partes designará un miembro, que podrá ser elegido entre sus respectivos nacionales. Los otros dos árbitros y el Presidente serán elegidos de común acuerdo entre los nacionales de terceras Potencias. Deben ser de nacionalidades diferentes y no deben tener residencia habitual en el territorio ni estar al servicio de las partes.
CHAPTER 4: GENERAL PROVISIONS
ARTICLE 29:
1. Disputes for the settlement of which a special procedure is laid clown in other conventions in force between the parties to the dispute shall be settled in conformity with the provisions of those conventions.
2. The present General Act shall not affect any agreements in force by which conciliation procedure is established between the Parties or they are bound by obligations to resort to arbitration or judicial settlement which ensure the settlement of the dispute. If, however, these agreements provide only for a procedure of conciliation, after such procedure has been followed without result, the provisions of the present General Act concerning judicial settlement or arbitration shall be applied in so far as the parties have acceded thereto.
CAPÍTULO 4: DISPOSICIONES GENERALES
ARTÍCULO 29:
1. Las controversias para cuya solución se establezca un procedimiento especial en otras convenciones en vigor entre las partes en la controversia se resolverán de conformidad con las disposiciones de dichas convenciones.
2. El presente Acto General no afectará a los acuerdos en vigor por los que se establezca un procedimiento de conciliación entre las Partes o éstas estén obligadas a acudir al arbitraje o arreglo judicial que asegure la solución de la controversia. Sin embargo, si estos convenios sólo prevén un procedimiento de conciliación, después de que éste se haya seguido sin resultado, se aplicarán las disposiciones del presente Acto General sobre arreglo judicial o arbitraje en cuanto las partes se hayan adherido a ellas.
