Zoning history. This site was rezoned from A-1 Residence to NH-H Health Facility at the owners' request in 1992. NH-H allows only a nursing home or hospital. A plan for a nursing home was prepared, but not implemented.
Application. The current owner states that he and his wife (in conjunction with a Trust for the benefit of this children) have owned and/or controlled the property since 1977 (6 acres) and 1980 (4 acres). He has had the land for sale for many years. His application is to have the site rezoned to L-1 Industrial and to subdivide it into 4 lots. Some data on the site and the proposal is in his Full Environmental Assessment Form.
On the Bypass west of Lincoln Boulevard, there is a residential IGHL home, although the land is zoned L-1. Tate's Bakery is to the south and east, west of Pine Street, and its lot is zoned L-1. For all zoning within 500', look at the radius map.
The layout of lots is not itself part of the change of zone application, but the owner has submitted a conceptual plan showing what he has in mind (a portion of the plan is on the right). Lincoln Boulevard, which is not opened, would remain closed and 4 L-1 lots would have access from the Bypass. The entire parcel would be subdivided.
The Town Board's approval of a change of zone may be conditioned upon on the applicant's agreeing to restrictions on how the property is used in the future.
County DPW commented on the plan by letter, saying that it would not support 2 access/egresses on the Bypass.
Hamlet Plan. In 1995, a study was conducted by the Town so residents could make recommendations that would become a plan for our hamlets. The recommendation pertinent to this application was "to encourage more L-1 zoning on Frowein Road, west of Lincoln Boulevard" (The Moriches Four-Hamlet Comprehensive Plan, 31 (emphasis added)). The selection of Lincoln Boulevard as the dividing line between L-1 and residential was voted on at a public meeting open to all and attended by many. (Lincoln Boulevard is a paper road on both sides of the Bypass, and is just trees south of the Bypass.)
The present site is immediately west of Lincoln Boulevard, and so changing its zone to L-1 would be contrary to the Comprehensive Plan's recommendation.
