The Original Application.

In December 2009, an application was filed to change the zoning of this site from mainly L-1-Industrial to PRCHC, which is a Planned Retirement Congregate Housing Community. In a PRCHC district, the only permitted use is "adult care facilities as defined and licensed by New York State Department of Health". The applicant is reportedly affiliated with the Cedar Lodge Nursing Home across Frowein Road from this site.

The plan applicant submitted was for a 200 bed nursing home on the front of the site and 80 age-restricted apartments to the rear.

The Long Environmental Assessment Form (LEAF) filed by applicant states that the site is in or continguous to a "Critical Enfirconmental Area". Immediately to the east of the site is a parcel owned by the Town that is mostly wetlands and includes the headwaters of the Terrell River. The Town owns parcels both to the north and south, and they are planned to form a trail, the Core to Shore trail, that extends from the Sound to Moriches Bay.

The LEAF provides data on traffic, taxes, and other issues. It states that the project will generate $1.4 million in taxes, but does not state what L-1 use of the parcel would generate or whether it would be more or less. Sewage treatment is to be provided by the Walden Pond treatment plant.

Amended Plan

Reportedly after discussions with the Town's Planing Division, applicant filed an amended plan in January 2012. Under it, the number of beds in the nursing home has been reduced to 80, 100 assisted living beds have been added, and the number of rental PRC units hase been reduced to 48. The general layout has been compressed somewhat to increase protection for the wetlands 150 feet to the east and for a pond in the front to collect surface water. Six of the 17 acres are to remain remain natural. Waste water is to be treated by the treatment plant next door at Walden Pond. To view the plan, click here (Jan. '12 version).

Applicant filed an Expanded Environmental Assessment Form in January 2012 and revised it in March 2012 (view main text in Google Docs; download a bookmarked version; get appendices). It describes the project in detail and presents its position on important environmental issues including water, emergency services, traffic and community character. It included a Fiscal and Economic Impact Analysis presents its views on school and other taxes and the economic effects of the project (view with Google Docs; download a bookmarked version).

The most recent version of the site plan is very detailed.

No action by Suffolk County Planning Commission, May 2012

The Town is required to refer a project of this size to the Suffolk County Planning Commission for its review in light of regional issues and County land use policies. The Commission staff filed a detailed report recommending approval and provided some non-binding comments. The Commission, however, was divided on the project and the Town was advised by letter that there were not enough votes in favor of any action.

Town Board approved a change of zone, June 2012

The application to change to site's zoning to PRCHC was heard by the Town Board on June 12, 2012. EMPOA submitted a letter supporting the application if 15 significant issues were resolved satisfactorily.

The Town Board approved the change at its June 26 meeting meeting.

Covenants not recorded, January 2014

The Town Board's approval was conditioned on the filing of a number of covenants. Applicant came back to the Town Board for 2 extensions of the time for filing, and the second one expired January 3, 2014. We have found no record of the covenants having been recorded. Without timely recording of the covenants, the approval lapsed.
