The owner of a private residence sitting on 2.9 acres by Harts Cove has submitted applications asking the ZBA to permit a division of the property into 3 building lots of (from west to east) 40,000, 32,852 and 47,602 sq. ft. A-1 zoning requires lots to be 40,000 square feet. Because this site includes wetlands of approximately 7,100 sq. ft. in its SE corner that are3 not buildable, it does not have enough area to allow for three 40,000 sq. ft. lots. The owner therefore seeks variances for lot area, lot width and front setback on the easterly and middle lots.

As shown by the plan submitted, nearly the entire site in on a slope downward to the wetlands in the SE corner forming a swale. Near the corner of Atlantic and Maple, the site is 24 feet above sea level according to the plan submitted. It slopes down to the level of the bay in the SE corner. As a result, the plan is to fill the easterly and middle lots to level them off somewhat. This will obviously have an impact on tidal activity, particularly during storms, since the swale would naturally absorb high water during storms.

EMPOA has submitted a letter analyzing of situation. The Peconic Baykeeper, Kevin McAllister spoke of the problems created at the ZBA's hearing on 4/18/12. The ZBA staff planner submitted a report, but raised no objection to the application, stating that "[n]o significant environmental impact is anticipated".

The hearing is to be continued on 5/2/12 at 2 pm.
