5.8 Civil Leave

A merit system employee may be given time off when required by proper authority to give testimony as a witness in legal proceedings. When the scope of the testimony arises from or is in the course if the employee’s regular work duties with the Health Department, then the employee shall receive regular pay. When the scope of the testimony is outside of the employee’s regular work duties or does not arise from those duties, then the employee may use accumulated annual leave (see section 5.1.) Otherwise, the leave may be approved as leave without pay (see section 5.13.)

5.8.1 Proof Required for Civil Leave Pay

An employee requesting civil leave pay must present the subpoena, court order or summons commanding his/her presence to her/his immediate supervisor upon receipt of the document. A copy of the subpoena (or equivalent) will be filed in the employee’s personnel file for as long as the personnel file is retained.

5.8.2 Pay for Civil Leave

The employee using approved civil leave will be paid for the hours she/he is normally scheduled to work up to eight (8) hours per day as per this policy and is not permitted to take other time off in lieu of this.
