3.7 Unforeseen Closure

In the event of special circumstances which could impact the safety of staff and visitors or impair business operations, the District Director of Health and/or her/his designee may declare, at her/his discretion, that any or all of NKY Health's locations are closed for all or part of the day.

3.7.1 Notification of Unforeseen Closure 

When appropriate, the District Director of Health and/or her/his designee will contact the media and emergency line(s) so notifications can be broadcast.

Upon learning of a special circumstance, such as inclement weather, an employee is responsible for finding out the following:

 The following are recommended sources to check:

 1 Required to Work means told by the supervisor or a higher authority in the chain-of-command that she/he must work

 2 Authorized to Work means told by the supervisor or a higher authority in the chain-of-command that she/he is permitted to work

3.7.2 Unforeseen Closure Types 

Depending on the circumstances, either some NKY Health-staffed sites may be closed while others remain open or all NKY Health-staffed sites may be closed.

3.7.2.1  Some Sites Open

An employee scheduled to work at a site remaining open must report to work as normal. An employee scheduled to work at a site that is closed must contact her/his supervisor for instructions.

3.7.2.1 All Sites Closed

When all sites are closed, an employee may be required to work. Supervisors will notify an employee required to work during a total closure.

3.7.3 Pay During an Unforeseen Closure 

An employee who works during an unforeseen closure will be compensated according to normal policies affecting compensation and in accordance with applicable federal, state, and local laws.

When a non-exempt employee’s site is closed due to an unforeseen closure and she/he is not required to work, she/he may use automatically approved leave without pay (see section 5.13.) for the hours she/he was scheduled to work but does not work during the closure. Alternatively, with her/his supervisor’s approval, she/he may do any of the following:

3.7.4 FMLA Leave During an Unforeseen Closure 

Time during an unforeseen closure does not count against an employee’s FMLA leave entitlement  (see section 5.12.)
