• • For PRO SE IP prosecutors and IP owners, it is not enough to simply focus on a short term, transactional approach and for 3rd-party IP practice owners, it is equally not enough to simply focus on a short term, transactional approach because organizations that own IP, like incorporated corporations are inherently designed to "forever exist". So an IP servicing plan must account for this long term view; anything less is an inefficient use of resources betrays a full and comprehensive understanding of the nature, quality and character of "what is IP" and its "benefit for the IP owner". 

  • If you are educating your IP customer or responsible to help your customer create, develop or manage IP, then you owe it to your customer to educate them that IP ownership is an ongoing process that requires daily management for as long as the goods and services associated with the IP are expected to be used-in-commerce.  For some organizations, like Coca-Cola Consolidated, Inc., their highly valued IP is over 116 years old, as of 2019 (Proof). Generations of humans including Top Management and Investors, Shareholders, Customers, Employees, Stakeholders of Coca-Cola Consolidated, Inc. have enjoyed both the financial benefits and non-financial benefits of its IP.

  • The implication is that your client must not enter into an IP plan without this foresight in mind and must set aside a necessary and sufficient financial budget to allow for IP management, not only for the interim time of creation and prosecution of the IP but for at least 10 years or for the expected life of the IP use-in-commerce or longer, for the expected life of the organization and its goods and services. Any less time frame and you are better off not accepting the organization as a client.

  • This is the minimum standard for IP creation and ownership.
