Pursuant to R.I. Gen. Law 16-13-3, the West Warwick School Committee recognizes that three annual contracts within five successive school years shall be considered evidence of satisfactory teaching and shall constitute a probationary period.
Provided however, that pursuant to decisions of the Commissioner of Education and of the Rhode Island Supreme Court, West Warwick School Committee hereby adopts this policy to be recognized and administered by the Superintendent of Schools that non-tenured teachers who have been absent for fifteen percent or more of possible school days in one of their probationary years, are not entitled to tenure. Absences of probationary teachers in excess of twenty-seven days in one school year even if sanctioned under state law prevent the year in which those absences are incurred from counting towards requirement of completion of three probationary years requirement.
Absences of probationary teachers in excess of twenty-seven days in one school year, even if sanctioned by state Parental and Family Medical Leave Act, prevent year in which those absences are incurred from counting toward Tenure Act’s requirement of completion of three consecutive years to qualify for tenure. Gen. Laws 1956 § 16-13-3, 28-48-3.
Absences taken by probationary teachers pursuant to state Parental and Family Medical Leave Act which result in twenty-seven days or more do not result in counting that particular year as part of the five-year period in which three years are to be completed.
This policy is commenced and is effective and applies to all teachers hired after June 1, 2005.
