Victim Services

Victim Advocates serve as your connection to prosecutors, law enforcement and other criminal justice agencies, and help to ensure that you have a voice in the criminal justice process. Your Victim Advocate will link you with local resources, provide you with case updates, and support you during court hearings and testimony. The Victim Services Unit helps victims from all walks of life and experiences, regardless of age, background and/or immigration status. Walk-ins are welcome and all services are free. Your Victim Advocate can assist you even if a suspect is not identified or if criminal charges have not been filed.

A ‘victim’ is defined under the California Constitution as a “person who suffers direct or threatened physical, psychological, or financial harm as a result of the commission or attempted commission of a crime or delinquent act. The term ‘victim’ also includes the person’s spouse, parents, children, siblings, or guardian, and includes a lawful representative of a crime victim who is deceased, a minor, or physically or psychologically incapacitated. The term ‘victim’ does not include a person in custody for an offense, the accused, or a person whom the court finds would not act in the best interests of a minor victim.” (Cal. Const., art. I, § 28(e).)

A victim, the retained attorney of a victim, a lawful representative of the victim, or the prosecuting attorney upon request of the victim, may enforce the above rights in any trial or appellate court with jurisdiction over the case as a matter of right. The court shall act promptly on such a request. (Cal. Const., art. I, § 28(c)(1).)


The goal of the Family Violence Center is to address family violence issues by serving as the core for a multi-agency effort. The Family Violence Unit focuses on three areas of behavior which most often victimize the family. The investigative units specifically address domestic violence, child/elder abuse and threat management (stalking). The center is staffed by representatives of the District Attorney's Office, Adult Probation, Child Protective Services, Police Department, and a victim advocate from Next Door, Solutions to Domestic Violence. This cooperative effort provides all the support services available to victims of family violence in a safe and friendly environment.

In conjunction with the Santa Clara County District Attorney’s office, the San Jose Family Justice Center brings together professionals and community resources for survivors of domestic violence in one centralized location. Survivors have the option to access as many services as best meet their individual needs. Includes free consultation with:

  • The District Attorney for legal issues and pending criminal cases
  • Family law attorneys to discuss restraining orders, divorce, child custody, and visitation
  • Immigration attorneys who can help a survivor apply for a VAWA or U-Visa
