Should a worker be required to work a 7th Consecutive day, the agreement stipulates certain criteria:
The shift in question is the 7th Consecutive shift in a row, that is, 6 Consecutive shifts have been worked before the shift in question.
The worker must have permission/approval to work this pattern of shifts
The request to work a 7th day should be pre-approved by the Producer.
If you do not have pre approval, there is a risk of the producer using this clause to contesting your claim for payment.
If there is no other choice but for the worker to enter into a 7th consecutive shift, it is highly recommended that local discussions take place to ensure that the worker does not become excessively tired, and does not become a danger to themselves, or others. This may entail providing a car & Driver to return the worker home, or local accommodation, to avoid excessively long hours .
This is in addition to a day being allocated as a day off for that individual worker , as soon as possible, a day not linked to the shooting schedule.
Note: some productions are claiming that 7 day provisions are not provided if the 7 consecutive shifts straddle different payroll weeks.
This is not an issue for administration, this is a matter of crew welfare, under the banner of Health & Safety, where workers are being subjected to continuous working without adequate rest.
The rate for working a 7th day is your normal Contracted day X 2
The 7th day fees are there as a financial disincentive to maintain the minimum weekly rest period
The 2017 TVDA was silent on 7th days as both sides during the negotiations agreed that no overtime should be worked on 7th Days
Should OT be required on a 7th day, this should be negotiated with the Producer BEFORE it is needed to be instigated.
Despite both sides agreeing that 7th Days were an exception, crew have reported working 8th, 9th, 10th + days
As stated above, the 7th consecutive day attracts an additional fee, because you are working 7 days in a row.
If you are working 8 days, or more in a row, by definition you are working 7 consecutive days on a rolling basis, essentially allocating the 7th day fee to each and every 7th day worked in succession, until a day off is taken.
for example, If you work 9 shifts in a row, day 7, 8 & 9 would be subject to the 7th day fee.
In all cases, a worker must get this approved by the Producer beforehand.
Clause 6.9 of the 2017 TVDA is entitled : Work on 7th consecutive day, and refers to any 7 days/shifts physically worked in succession.
It could be a run of shifts that start on a Tuesday & ends the following Monday, or on a Saturday through to Friday, or Sunday to Saturday.
They are all examples of consecutively run shifts.
There is no weekly reset in any agreed documentation.
