The 2-judge division bench engaged the JNTUH Standing counsel crisply. The bench asked in the sense of "Why did you cancel the transfer order violative of the fundamental rules which enshrined 7-day joining time provision." The JNTUH Standing Counsel merely blindly lamely said of administrative grounds.
The bench mentioned that a writ appeal is filed though the case is unappealable.
The bench questioned as to why the writ appeal is filed neglecting the vacate stay provision. The bench compared dismissed on merits Vs. dismissed as withdrawn. The bench said that if they pass the order of dismissal on merits, it would narrow down the possibilities for the vacate stay provision/petition and sought to know if JNTUH could better have the writ appeal dismissed as withdrawn.
