Eligibility Decision

There are certain circumstances where you may enter or edit the response to the statement, "The case conference committee has determined that the student's disability adversely affects the students educational performance". These are determined by the Purpose of the case conference.

An "eligibility event" will be created at each of these types of conferences:

If Reevaluation or Initial is the purpose of the conference, the school psychologist (or SLP if speech only) will determine whether the student is still eligible for services.

If the purpose of the conference is an Annual or Move-in, it is the TOR's responsibility to "Create Eligibility". Click Create Eligibility.

The example above shows a possible initial conference, where the evaluator still needs to add the evaluation scores and summaries.

After that is done, and the case conference committee has made a decision, an eligibility event will need to be created.

If you are waiting for others to add information to this page (ie, the SLP or the psychologist will be adding testing information). wait to create the eligibility until they are done. This will not prevent you from creating a Draft IEP.

Opening the Reasons for Eligibility Determination box:

If the purpose of the conference is Initial, Move In or Annual, the Reasons for Eligibility Determination box will be editable. In most cases, only the Psychologist or SLP will add information into this field. The TOR may enter the information from the previous school here in the case of a Move In conference after consulting with the school psychologist.

The example above shows a possible annual case conference.

If a student has multiple disabilities and they have secondary Speech/Language disabilities, be sure to list either LI or SI as the FIRST secondary disability, and before the other disabilities. This affects our funding, but does not affect the students services in any way.

Reasons for Eligibility Determination

This box contains the test scores and evaluation process used to determine the student's eligibility. Once the information is entered, it does not need to be changed until new testing has been completed.

At an initial IEP, the Reasons for Eligibility will be completed by the SLP and/or school Psychologist. If there is a move-in conference, the TOR will enter the test scores and evaluation results received from the previous school.

Creating an Eligibility Event

When eligibility has been determined, and at each Annual Case Conference, you will create an Eligibility Event to reaffirm that the current information is accurate. Click the Create Eligibility Event button to be taken to the following screen:

Enter the date of the conference and click "Create Eligibility Event and Continue". Do not delete any eligibilities unless you are a psych or an SLP. The only changes that Teachers of Record could make might be to re-order eligibilities to move LI or SI to the secondary position. The Create Eligibility button may remain until the IEP is finalized.


When you are finished, the gold bar will show on the Student History page to indicate that the eligibility was reaffirmed.

Ineligibility

Student is determined to be ineligible after an initial evaluation or a reevaluation. This determination must be made by a psychologist and/or SLP. They will generate the Notice of Ineligibility and complete the paperwork.

Note: If the parent decides that they no longer want their student to receive special education services, you will create the Revocation of Services. You will not generate the Notice of Ineligibiity.

  • If the student is ineligible or no longer eligible:

For Initial and Reevaluation: In declaring the student ineligible, the Notice of Ineligibility will be an option. A Sample is included below. There is no need to create a full IEP, since the student is ineligible.

For Reevaluation: Before declaring a student ineligible, testing should have been requested at a previous IEP conference, for the purpose of adding or removing a disability area. Parent permission should have been obtained. The psych or SLP will complete the preconference planning and evaluation sections of the IIEP.

This testing must be completed before the IEP, to provide the information of ineligibility (done by psych or SLP, depending on the eligibility category). Testing information should be included by the appropriate evaluator under the Evaluation Process.

  • Print out the Draft of the Educational Evaluation Report (from the Evaluation Process section) Attach any other evaluation reports (Psych report, OT Screening, SLP Evaluation, etc.)

  • The psych or SLP (person who will remove the disability) must be in attendance at the case conference.

  • Hold the conference and take good notes. Have the parent sign the Notice of Ineligibility. There is no signature line, but draw a line for signature and date, and have them sign it.

  • Send downtown:

      1. Signed Notice of Ineligibility

      2. Notes of the Conference

      3. Copy of the Psychological Evaluation Report or Speech Report (usually sent in by the psychologist)

      4. Sign In Sheet

      5. Notice of Case Conference

  • If the student is ineligible or no longer eligible for one disability, but still qualifies under a different eligibility:

If you are just removing ONE area of eligibility, but other areas remain, then your answer here will still be "Yes"

  • Attach any other evaluation reports (Psych report, OT Screening, SLP Evaluation, etc.)

  • The psych or SLP (person who will remove the disability) must be in attendace at the case conference, and explain to the parent which disabilities will be removed.

  • Hold the conference and take good notes.

  • After the conference, and before finalizing the IEP, the psych or SLP should remove the disability for which the student is no longer eligible.

  • Complete the rest of the IEP paperwork as usual.

  • Send downtown:

      1. Notes of the Conference

      2. Copy of the Psychological Evaluation Report or Speech Report (usually sent in by the psychologist)

      3. Sign In Sheet

      4. Notice of Case Conference

      5. Finalized IEP
