Abortion Extradition In New York State In the Wake of the Dobbs v. Jackson Ruling

Abstract

In the wake of Dobbs v. Jackson (1973), the federally given right to abortion has become unprotected by the Constitution, resulting in each state holding widely different laws and restrictions against the right to abortion. As New York State strengthens its abortion provisions, an influx of women traveling to New York State to obtain a legal abortion is now a current reality. This influx has already resulted in investigations into the private act of legal abortions, furthering the threat of extradition (apprehension in one state when the defendant has an arrest warrant from another) and begging action for the future of New York State provisions. This project will outline the risks that women face when obtaining out-of-state abortions (particularly in New York State), analyze extradition law under the scope of abortion, and will establish a basis for a human rights perspective of abortion.
