SECTION 1. The Management recognizes the College Faculty Union as the sole and exclusive bargaining agent of the regular College Faculty, excluding the College of Law, as certified by the Med-Arbiter of the Department of Labor and Employment, Regional Office No. XI in Case No. OS-A-27-7-06 (R1100-0604-RU-006).

SECTION 2. The College Bargaining Unit is composed of a) College Faculty Union members with full teaching loads or hired to professional services positions or formation program positions, b) Union Faculty members with Administrative Assignment Load, and c) those appointed to Administrative positions with Faculty status. Contractual, probationary, and part-time faculty members in the undergraduate and/or graduate levels and in the College of Law are excluded from the Union.

SECTION 3. While the Management continues to exercise its inherent hire-and-fire function relative to the employment of college faculty members based on its operational requirements and according to procedures and policies provided by law, it agrees that regular faculty members who are hired before and after the signing of this agreement shall be required to become and remain members of the Union of good standing as a condition of continued employment. Union membership automatically takes effect upon the date of the regularization of the faculty.

SECTION 4. The Union shall have the right to recommend in writing to the Management the termination of any regular member who refuses to become a member of the Union 15 days after becoming a regular faculty member or who ceases to become a member of good standing. Such recommendations for termination shall be immediately acted upon by the Management who shall conduct an appropriate investigation and make the necessary approval thereof within 15 days after receipt of notice.

SECTION 5. The Union agrees that Union Faculty members with Administrative Assignment Load, and those appointed by the University President to an Administrative position with Faculty status under Section 2 of Article II of this agreement shall be considered on leave from the Union but remain members of the Bargaining Unit during the term of their appointment. They shall be reinstated to Union membership upon the expiration or non-renewal of their appointment and continue to become active members of the Union.

SECTION 6. A Union member of good standing undergoes Basic Course on Trade Unionism (BCTU) and other union trainings, pays his/her monthly Union Fees/dues, actively involves in the Union operations and attends all General Assemblies.
