Artículo
1. Esta Ley tiene por objeto establecer los principios, derechos, obligaciones y procedimientos que regulan la protección de datos personales, considerando su interrelación con la vida privada y demás derechos y libertades fundamentales de los ciudadanos, por parte de las personas naturales o jurídicas, de derecho público o privado, lucrativas o no, que traten datos personales en los términos previstos en esta Ley.
Toda persona, natural o jurídica, de derecho público o privado, lucrativa o no, puede efectuar el tratamiento de datos personales, siempre que lo haga con arreglo a la presente Ley y para los fines permitidos en el ordenamiento jurídico. En todo caso, deberá respetar el pleno ejercicio de los derechos fundamentales de los titulares de los datos y de las facultades que esta Ley les reconoce.
Article
1. The purpose of this Law is to establish the principles, rights, obligations, and procedures that regulate the protection of personal data, considering its interrelation with privacy and other fundamental rights and freedoms of citizens, by natural or legal persons, under public or private law, whether for profit or not, who process personal data under the terms provided for in this Law.
Any natural or legal person, whether governed by public or private law, for profit or not, may process personal data, provided that they do so in accordance with this Law and for the purposes permitted by law. In any case, they must respect the full exercise of the fundamental rights of the data subjects and the powers recognized to them by this Law.

The purpose of this Law is to establish the principles, rights, obligations and procedures that regulate the protection of personal data, considering the interrelationship with private life and other fundamental rights and freedoms of citizens by natural or legal persons under public or private law, whether lucrative or not, who process personal data in the previous terms in this Law.
Any natural or legal person under public or private law, whether gainful or not, may process personal data provided that it does so in accordance with this Law and for the purposes permitted by law. In any case, it must respect the full exercise of the fundamental rights of the holders of the data and the powers granted to them by this Law.

Artículo 5.
Las bases de datos que se encuentren en el territorio de la República de Panamá, que almacenen o contengan datos personales de nacionales o extranjeros o que el responsable del tratamiento de los datos esté domiciliado en el país quedan sujetas a las normas establecidas en esta Ley o su reglamentación.

Artículo 38.
Las infracciones a esta Ley se califican en leves, graves o muy graves.

Artículo 43.
Las infracciones a esta Ley serán sancionadas así:
1. Falta leve, citación ante la Autoridad Nacional de Transparencia y Acceso a la Información con relación a registros o atender faltas.
2. Faltas graves, multas según su proporcionalidad.
3. Faltas muy graves: Clausura de los registros de la base de datos, sin perjuicio de la multa, correspondiente.
4. Para ejecutar esta acción, la Autoridad Nacional de Transparencia y Acceso a la Información deberá contar con la opinión formal del Consejo de Protección de Datos Personales, sin perjuicio de los recursos que esta Ley le concede al afectado.
5. Suspensión e inhabilitación de la actividad de almacenamiento y/o tratamiento de datos personales de forma temporal o permanente, sin perjuicio de la multa correspondiente.
6. Se considerará reincidencia cuando la misma falta se repita dentro de un periodo de tres años.
Article 43.
Violations of this Law shall be punished as follows:
1. Minor offense: summons before the National Authority for Transparency and Access to Information in relation to records or addressing offenses.
2. Serious offenses: fines according to their proportionality.
3. Very serious offenses: closure of the database records, without prejudice to the corresponding fine.
4. To carry out this action, the National Authority for Transparency and Access to Information must have the formal opinion of the Personal Data Protection Council, without prejudice to the remedies granted to the affected party by this Law.
5. Suspension and disqualification from the activity of storing and/or processing personal data on a temporary or permanent basis, without prejudice to the corresponding fine.
6. A repeat offense shall be considered when the same offense is repeated within a period of three years.
Article 43.
Violations of this Law shall be sanctioned as follows:
1. Minor fault, summons to the National Authority for Transparency and Access to Information in relation to records or dealing with faults.
2. Serious offenses, fines according to their proportionality.
3. Very serious faults, Closure of the database records, without prejudice to the corresponding fine.
4. To carry out this action, the National Authority for Transparency and Access to Information must have the formal opinion of the Personal Data Protection Council, without prejudice to the resources that this Law grants to the affected party.
5. Suspension and disqualification of the activity of storing and/or processing personal data temporarily or permanently, without prejudice to the corresponding fine.
6. It will be considered recidivism when the same fault is repeated within a period of three years.
