Điều 46. Cơ sở kiểm nghiệm thực phẩm

Article 46. Food testing establishments

1. Cơ sở kiểm nghiệm thực phẩm phải đáp ứng các điều kiện sau đây:

1. A food testing establishment must satisfy the following conditions:

a) Có bộ máy tổ chức và năng lực kỹ thuật đáp ứng yêu cầu của tiêu chuẩn quốc gia, tiêu chuẩn quốc tế đối với cơ sở kiểm nghiệm;

a/ Having an organizational apparatus and technical capacity meeting the requirements of national or international standards applicable to testing establishments;

b) Thiết lập và duy trì hệ thống quản lý phù hợp với yêu cầu của tiêu chuẩn quốc gia, tiêu chuẩn quốc tế;

b/ Establishing and maintaining a managerial system meeting the requirements of national or international standards:

c) Đăng ký hoạt động đánh giá sự phù hợp với tiêu chuẩn, quy chuẩn kỹ thuật với cơ quan nhà nước có thẩm quyền trong trường hợp thực hiện hoạt động chứng nhận hợp chuẩn, hợp quy.

c/ Registering the operation of assessment of conformity with standards or technical regulations with a competent state agency when engaged in certification of standard or regulation conformity.

2. Cơ sở kiểm nghiệm thực phẩm được cung cấp dịch vụ kiểm nghiệm, thu phí kiểm nghiệm và phải chịu trách nhiệm trước pháp luật về kết quả kiểm nghiệm do mình thực hiện.

2. Food testing establishments may provide testing services, collect testing charges and take responsibility before law for the results of tests they perform.

3. Bộ trưởng Bộ quản lý ngành quy định cụ thể điều kiện của cơ sở kiểm nghiệm quy định tại khoản 1 Điều này.

3. Line ministers shall specify conditions for testing establishments defined in Clause 1 of this Article.
