Title IX & SB 212

Your role in a safe and respectful campus.

Title IX is a federal law prohibiting sex-based discrimination in education programs, while Texas's Senate Bill 212 (SB 212) is a state law that creates mandatory reporting requirements for university employees regarding incidents of sexual harassment, sexual assault, dating violence, and stalking to the Title IX coordinator. SB 212 mandates that these employees promptly report incidents they witness or are informed about, and it also requires the collection and public reporting of this information by the institution. 

Title IX

  • What it is: A U.S. federal law that prohibits sex discrimination in educational programs and activities receiving federal funding.

  • Scope: This includes discrimination based on sex, sexual harassment, sexual assault, dating violence, domestic violence, stalking, and sexual exploitation.

SB 212

  • What it is: A Texas state law passed in the 86th legislative session that establishes mandatory reporting for certain sexual misconduct. 

  • Who must report: All employees of Texas colleges and universities. 

  • What must be reported: Incidents of sexual harassment, sexual assault, dating violence, or stalking involving a student or employee. 

  • How it's reported: Employees must report incidents to the campus Title IX coordinator. 

  • Reporting to the state: The Title IX coordinator must provide quarterly written reports to the chancellor and publish an annual report on all received reports, investigations, and disciplinary actions. 

  • Exclusions: The law does not require students to report. 

How SB 212 and Title IX Relate

  • SB 212 complements Title IX by creating specific state-level reporting obligations for university employees, ensuring these reports are funneled to the Title IX coordinator for investigation under Title IX guidelines. 

  • While Title IX addresses the prohibition of discrimination, SB 212 focuses on the mandatory process of reporting and documenting incidents of sexual misconduct within the higher education system.
