I attach a copy of the listings that you kindly sent for identification purposes marking in big red print the item number under the name of Deputy Registrar Nicholas Briggs (page 27) on 12 November 2014 at 10.30am in Hearing Room 11.
It is vitally important that the way in which this event happened, as recorded on the listing board, is not added onto the transcript. The details which are correct are:
1) Deputy Registrar Nicholas Briggs
2) the date and time
3) the court room
4) the identity of Dawn McCambley the person heard
5) the person Dawn McCambley was paid by who was Tim Symes of DMH Stallard
File 3630 of 2013 itself was heard in front of Mrs Justice Andrews on 22 December 2014 on referral from Guy Newey who was the Duty Judge for the Rolls Building from Friday 19th December 2014. This itself rose in the context of the attempt to get the Royal Bank of Canada claim form issued on Friday 19 December 2014 which seems to have been deflected by Flaux J according to xxxx and xxxx.
File 3630 of 2013 itself is not a bankruptcy file. On inspection it contained the served copy of HQ12XO3512 Mira Makar v The Baker Tilly Partners damages starting at £200m. Master Leslie found the file in the basement of the RCJ on 7 November 2014 but with the file labelled Mira Makar v Rider One.
Rider One is a reference to 2012Folio336. Rider One of this claim form comprises a list of defendants and their address for service at the time the claim form was issued but not served on 5 March 2012.
The transcribers are required to follow the content of the EX107 unless xxxx or xxxx say anything else. Please could you get their agreement to the EX107 before you send it out for transcribing, and let the transcribers know that Rolls Building Management has checked the form and has no objections.
Apologies re the second attachment. I sent you the picture of the front page rather than the full document, which I now attach.
I am also re-sending in the email the EX107 without the email from Dawn McCambley to see if you can open it better this time. It would be as well the transcriber does not see this email, it was only included to help you find the transcript and also because the barrister who was heard on 17 January 2017 in front of Field J in the Commercial Court (2012Folio336) could not be identified by the court. As there was some uncertainty because the listing under Registrar Jones, turned into a listing under Deputy Registrar Briggs on 12 November 2014, and it was thought expedient to assist the court.
