NOTICE TO 2012 Folio 336 DEFENDANTS

Status of 2012 Folio 336

2012 Folio 336 in the Commercial Court was issued on 5 March 2012, by the six year deadline under the Statute of Limitation and two year deadline under the creditor preferment rules.

It was served on 4 July 2012, and properly public on inspection on 18 July 2012, when default judgment was entered.

Witness (Claimant): The position is that Kingston Smith cannot give any instructions in regard to me. Their position as a statutory auditor is untenable and under the normal position when you are in possession of information that everybody else has not got you cannot pull the rug from under your customer’s feet………. You have to remain independent. So, so long as you have got a reasonable belief that they are going to succeed, whether it is legitimate or illegitimate, you cannot do anything about it, but you do not control the information, so when they got a copy of my claim against Baker Tilly, which is fatal, they are obliged to give it to Baker Tilly.

What Baker Tilly does with it is not under Kingston Smith’s control, and the fact that Mr. Parker popped up with it in the Queen's Bench Division on the 23rd October is a question which is not for this forum, as to how he got it and to what purpose it has been put.

So I am constrained. I am determined to behave correctly and I am looking for deemed admissions which to the outside world are totally innocuous.

Judge: I understand. I am sure that counsel have heard that and will consider with their clients whether any further admissions can usefully and should be made.

Extract 2:

Judge: I have got the power to make any such orders I should exercise in this case.

Witness (Claimant): Is there any possibility that the terms in which I wrote my N227 and my N30 can actually be included in the judgment? I used particular words.

Judge: If you identify exactly what you would like recited I shall consider including that in my ruling.

Witness (Claimant): I used the unilateral judgment form and then I said ----

Judge: Do you have a copy of it? Is that a copy that I can keep?

Witness (Claimant): Yes. (Document handed) And I entered it apart from any proper returns compliant with the rules, so it is an effective -- so if somebody comes back with a proper return saying, “I recognise this claim is not severable but it is a case of mistaken identity, not me”, that gets through, and then without prejudice to the generality of the foregoing, I express or reject (sic.), and then there are the final little words.

Judge: I have got two copies. Are they the same?

Witness (Claimant): No, they will probably be different defendants.

Judge: Oh, you are right, yes. Oh, I see. Yes, you have given me the first four.

Witness (Claimant): Yes. They are all the same, because that basically says if you have

got something proper to say that is fine.

Judge: But that is the judgment in default that you have.

Witness (Claimant): Thank you.

Judge: There we are, that completes the story.

Attached PDF and WORD of notice, for to morrow morning please. I have received a threat of another attack this week, and this is the only way that it can be stopped. It needs to go up asap, as by mid day to morrow the court might have listed & will be defensive.

I have given the papers to police but they are having to learn these cyber crimes from scratch which takes time, and the Insolvency Service is being detached as an onlooker.

I look forward to hearing this is safely received. Will pay by phone when you are ready.

14 DAYS NOTICE TO THE FORMER PARTNERS OF BAKER TILLY, WHO CEASED BUSINESS ON 1 APRIL 2007, DISSOLUTION UNDER s137 1890 PARTNERSHIP ACT, 7 JUNE 2007 ( LONDON GAZETTE)

Charging orders apparently obtained in the name of and on behalf of the former partners in the dissolved partnership were secured in September 2009 and in April 2011 over a controlling stake in a public company emanating, it is said, from a claim 7MY03183 made on 26 June 2007 in the name of and on behalf of the former partners.

These charging orders, (which are in any event subordinated to pre existing actual charges in favour of the Royal Bank of Canada from October 2006), were placed on the company’s public register maintained by Equiniti under reference HQ08X02310 on 18 September 2009 and 27 April 2011.

On 10 June 2011 a financial crime designation in regard to these transactions in quoted securities (ref: F178/11) was made on the register. No order of the court has been made on the company.

Any former partner who considers himself responsible for making these entries

on the register claiming they believe they may be entitled to have an equitable

interest in the securities, which they can demonstrably show derives from

the substance of the claim made in June 2007, and who wishes to be notified

Dear XXXXXXXX

Attached judgment in default v Kingston Smith LLP, auditor of the Baker Tilly group (LLPs) whose appointment lapsed when the group lost capacity (2012 Folio 336).

The claim is not hostile v KS, and "protects" them from the partners & creditors on the demise of the BT group. Please pass to compliance. I have drawn your attention to the fact the default judgment was hidden from the judge, who made a point of asking me for it and putting that fact on the transcript.

The docs were stamped on the back, not front & apparently hidden in the basement of the court.

The KS one (and 4 others) were stamped back & front (with different dates). There will be some financial engineering in how these were selected.
