WORD DOCUMENT (UNPROTECTED)
NAME ON DOCUMENT:
Triad Group Plc v Makar 2020 EWHC 2701 (QB) - amended -1.doc
Content (embargo'ed) appeared on BAILII at least uploaded Saturday 21 November 2020 (court date Monday 23 November 2020)
There are no proceedings in QBD entitled Triad Group Plc v Makar
There are no public documents, as the assumed "defendant" did not reply to a claim form issued on 18 December 2018, at the request of Jonathan Hambleton and Freeths LLP (formerly Kimbles).
These are already in QBD under HS06XO1803 Herbert Smith v MM, D&CC £21m. This is funded (in part) by ALLIANZ GROUP PLC. The relevant inter party evidence dates from before the TRD prelims July 2005.
This was heard 13 February 2020 before Saini J. It related an exchange of comms HS and A&O April 2005. It is on the subject of bullying, violence, denigration of MM's Christian belief, with perjury from October 2006, generated in support of an application to strike out MM's evidence on
these issues.
Importantly Alistair McIntyre Fulton used A&O (MM's family's lawyers) and MM's A&O file reference, to accuse MM of malicious falsehood (April 2005).
He went on with others to seek a strike out of MM's evidence in November 2006. By this time there had been a fire at A&O's warehouse, taking source of money records, deeds, certificates, leases, contracts, IPO's, valuations for cross border transactions, wills, statutory books. It was not notified to the courts (12 July 2006).
The theme of destruction of evidence continued adding to obstruction of access (including access to life insurance policy, medical expenses insurance, medical records, reports and scans, personal and family phone books, details of stone mason building gravestone -April 1996, brief case, board papers, e-mail, computer servers, tax and bank records, share certificates). In August 2016 TRD was blocked from publishing the results of proxy poll voting.
Stephen Sanderson FCA, former Co Sec Vega Group Plc had refused to sign the 31 March 2016 accounts after members' insisted that:
1) proxy poll voting had to take place after a decade (2005 - 15) of disenfranchisement of members;
2) members had to vote first on officers, then on their efforts to manage post opening, address labels for shareholder notices, investor comms, a board to agree RNSs, maintenance of a members' register
Six year damage mitigation claims to protect ALLIANZ GROUP PLC are:
1) MM v A&O (fire 12 July 2006), ALLIANZ funded
2) MM v PwC (statutory offences, including no letter to management prior to making an adverse report (books and records "B&R" in the jargon), ALLIANZ funded
3) MM v Baker Tilly UK Group LLP & Ors (rest of group) - Re contract concluded between Burges Salmon LLP and the partners together with a second between Burges Salmon LLP and ALLIANZ GROUP PLC
