What is Deviation?
A deviation refers to any language within a Space Act Agreement that diverges from NASA's standard language in the following clauses:
(1) Non-exclusivity;
(2) Priority of Use;
(3) Liability and Risk of Loss related clauses;
(4) Intellectual Property Rights related clauses;
(5) Release of General Information to the Public and Media;
(6). Use of NASA Name and Emblems;
(7) Compliance with Laws and Regulation;
(8) Right to Terminate related clauses
To collaborate with domestic non-Federal Government partners, you must obtain advance written approval from the Director of the NASA Partnership Office (or their authorized representative) if you intend to exclude or alter any of the following standard clauses that would typically apply to the specific agreement.
Steps Required Prior to Submitting an Deviation Request Package to the Headquarters Partnership Office:
Verify that the proposed modifications pertain to the specified clauses
Search for previously approved deviations using the Deviations Database or additional guidance from AA2 Team.
Obtain legal concurrence from your assigned attorney. Changes not approved by JSC OGC cannot be submitted for HQ approval.
Inform NASA TPOC and Partner about the deviation approval process and discuss any possible concerns.
