The DOE leaves this up to the designer to determine if they want to release their files or not to the contractor. If CAD files are released, recommend the contractor sign a disclaimer statement.

Word of caution with releasing CAD files to the contractor. In one case the designer released the CAD files to the contractor and the contractor turned around and submitted the same drawings back to the designer as a submittal. When something didn't work out in the field during construction, the contractor blamed the Architect and said it was his drawings. The contractor didn't bother to field verify the site.
