Regular Board Meeting (10/24/2013)

BOARD ATTENDEES: Mike Hogan, Mike Sandstrum, Ray Dalto, Briana Francois, Tyler Linkenhoker (ABSENT: Frank Maruco, George Sinclair).

New Property Manager -- Mike H introduced Frank Santoro of Sentry Management. Welcome Frank!

Financial Report -- Mike S reported a cash balance of $83,439 or which $57,335 is held in surplus (previously known as the reserve fund). As of 9/30/13, there are 3 homeowners in arrears totaling $1,135. There are legal fees owed the Association of $6,670. Our current year annual expenses are in deficit position of $2,462. However due to cash flow / bill timing, this is not a problem.

Property Manager Report -- Frank S reported that since 9/30/13, approximately $4,000 in legal fees have been billed to the Association. Other issues: A boat parked on a lawn on 13th Avenue Circle (Phase 2) needs to be out of site behind a fence. Property Management is handling the situation.

Annual Meeting -- Confirmed for Thursday, DEC 12th @ 7:00 p.m.

Architectural Review Committee (ARC) -- Ray reported there is lots of remodeling activity, but no issues to raise.

Ficus Trees -- Ray reported on estimates requested to deal with the 21 ficus trees on common grounds. These are invasive trees. To completely remove these trees, grind the stumps, repair/replace sod (etc.) the bids ranged from $54,000 to $60,000. This works out to about $3,000 per tree. To trim the trees and install root barriers, the estimate is $24,000. No action was decided at this time.

Christmas Lights -- Ray reported on an estimate Frank M got to replace the ten year old Christmas lights for the front entrance. The Board authorized spending up to $300 for new lights.

2014 Budget -- Mike H reported that the Board recently held a budget workshop. The 2014 budget includes increases for electricity and Bright House cable TV. However these increases will be offset by decreases in other budget categories. The annual homeowner dues will remain the same at $1,000. The Board approved the 2014 budget.

Open Discussion -- There were two comments from the floor:

    • Len Sirotzki made an appeal to the Board regarding the son of a couple who own a home in Phase 1. Len argued that the legal action the Board is taking on the son, on behalf of the Association, is having a negative impact on the parents / homeowners. Also, Len called into question the ability of the Board to use Association budget for legal services in this matter without informing the Association at large.

    • Mike Hogan, on behalf of the Board, stated that the son is not a resident, and under the sunshine law the HOA Board is permitted to consult with counsel privately.

    • Pam Bawden, who was directly impacted by the son's behavior, shared her feelings on the matter.
