Will Bk 1, p 6 ....

Frederick County, in Virginia.

In the name of God Amen, I John Fletcher of the parish of Norbourne

in the County of Frederick in the Colony of Virginia being at present

sick and weak of body yet of .........

.... Item, I give and bequeath to my loving wife Elizabeth Fletcher

for and during her natural life or widowhood full perogative of all

my lands and plantation whereon I now live containing three hundred

and fifty acres being in two surveys and if she my said wife should

marry then my will is that she have her third as the law directs and

the said land and plantation to be rented out at the discretion of

my executors until my children come to age as hereafter mentioned.

Item, I give and bequeath to my two sons John & Richard Fletcher and

the child Wherewith my said wife is now pregnant if it be a man child

all my said land and plantation to be equally divided as hereafter

mentioned. My eldest son John Fletcher to have his part the Upper

part of the place formerly belonging to Joseph Basher next towards

John Watsons in the lower part of the old survey, adjoining David

Garrards and my second son Richard Fletcher the other part of half

my land and plantation provided the child wherewith my wife is now

pregnant be a girl or shall die under age but if it should be a boy

and live to come to age my said second son Richard Fletcher to take

his part adjoining his said brother John Fletchers part of land and

the other part adjoining the said Richards part, the whole land to

be equally divided between the two or three sons by straight line or

lines provided the barn be in Richards part .... to have have and

possess the lands when they shall come to age of twenty one years or

at the decease of their mother my loving wife Elizabeth Fletcher if

she continued my widow to their heirs and assigns forever. And my

further will is that my said sons do pay to my two daughters Mary

and Sarah Fletcher the sum of five pounds to each of them the monies

to be paid within two years after the said sons comes of age, and if

the child wherewith my wife is now quick be a girl that she receive

likewise the sum of five pounds from my said two sons John and

Richard as is before directed and as for my moveable estate if any

be after my just debts and funeral charges be paid my will is that

if be equally divided between all my said children and Lastly I do

hereby Constitute ordain and appoint my said loving wife Elizabeth

Fletcher and my trusty friends David Garrard and Thomas Falkner

[Faulkner ?] joint executors of this my last will and testament

At a court held for Berkeley County this 16th day of June 1772 this

last will and testament of John Fletcher decd was exhibited to the

court and was proved by the oaths of Charles Snodgrass and Morgan

Morgan witnesses thereto and ordered to be recorded and was sworn

to by Elizabeth Fletcher and David Garrard and on the motion of the

said Garrard certificate is granted him for obtaining a probate

thereof in due form he having given bond and security according

to law. Thomas Falkner the other exec therein named and the said

Elizabeth refusing to take upon themselves the burden of the

execution thereof.

Joseph Riffey, Parish of Norbourne, Frederick Co. names wife Ellen

Riffey, son-in-law Samuel Parks, son-in-law John Snodgrass and both

are to act as joint executors. Will dtd 11-2-1771.

Exhibited in court 3-15-1771.

Witnesses Matthew Riffey, David Ferard (vss - we need to verify if

this is same person as David Garrard !), M. Morgan to will;

in court David, Isaac and Joseph Riffey.

p. 41-2 - Will Book No. I, p. 29-30 James Glenn, on Tuscarora,

in will of 3-11-1774, names sons John Glenn, James Glenn,

William Glenn, dau. Lena (?) Miller (vss - typo ? Will transcription

by Christine Bergen says it is Jane), Margaret Snodgrass,

wife Martha Glenn.

John Snodgrass, James Morrison and John Miller were witnesses.

Presented in Court at Berkeley 5-17-1774 where John Snodgrass and

John Miller swore to it.

p. 61-2 - Will Book No. I, p. 41 Martha Glenn of Berkeley Co on

3-24- (1775 ?) names son John Glenn, daughter Margaret Snodgrass

and Jane Miller, son William Glenn.

John Snodgrass (his mark), Hugh Lyle, and John Miller were witnesses.

Presented in court 8-15-1775, with same witnesses.

p. 414-5-6 - Will Book No. I, p. 476 Will of John Snodgrass on

1-10-1786 in Berkeley Co., names 3 sons William, Benjamin and James

(his plantation where he lives on Tuscarora Run), dau. Elizabeth,

wife of Samuel Kennedy, dau. Catherine Snodgrass, dau. Sarah,

wife of William Eakin, son John.

Presented in court 2-19-1788.

[vss - When I learned of the above wills in 1993 from a paper given

to me by SCS member James J. Snodgrass of Costa Mesa, CA, I called

the Berkeley Co. Court Clerk's office. A Mrs. Unger there told me

the old wills are not to be xeroxed, but that I could contact Don C.

Wood of The Berkeley Co Historical Society and have someone go to

the courthouse and hand-copy the will. In spring 1997 I met SCS

member Millie Fry of Cortland, OH, told her of the Charles

Snodgrass - Morgan Morgan signatures on the John Fletcher will,

and in fall 1997 Millie contacted Don Wood and was sent the

transcription. Millie sent me a xerox May 1998 - it is a copy

typed long ago and it is not notarized.]

David Snotgrass, Deft.

This day came the Parties by their Attorneys and the

Defendant Prays and has leave to Imparle till the next Court, and

then to Plead; and upon the motion of the Defendant ordered that

a Dedimus do Issue to take the Disposition of Joseph Snotgrass.

18 Aug 1772 -- Minute Book 1, page 39: George Scott Plt. against

Joseph Snodgrass Deft. upon a petition. This day came the Plt. by

his Attorney and the Deft. having been duly summoned and not

appearing tho solemnly called It is Therefore Considered by the Court

that the Plt. recover against the Deft. two pounds fourteen

shillings and eleven pence and his costs by him in this behalf

expended.

18 Aug 1772 -- Minute Book 1, page 40:

George Anderson, Plt. against William Snodgrass, Deft., upon a

petition. This day came the Plt. by his attorney and the Deft.

having been duly summoned and not appearing tho solemnly called.

It is therefore considered by the Court that the Plt. recover

against the Deft. four pounds sixteen shillings and his costs by

him in this behalf expended.

19 Aug 1772 -- Minute Book 1, page 44: William Blair Plt. against

David Snodgrass Deft. This day came the Parties by their Attornies

and the Defendants say they are not guilty in mannor and form as

the Plaintiffs against them have complained and of this they put

themselves upon the county and it is ordered that these suits be

continued to the next court.

19 Aug 1772 -- Minute Book 1, page 61:

Joseph Snodgrass Plt. against Robert Jones Deft., in debt.

The Defendant being summoned and failing to appear tho solemnly

called on the motion of the Plaintif by his attorney It is ordered

that unless the Defendant shall appear at the next Court and Plead

to Issue that Judgement shall be given the Plaintif against the

said Defendant and Walter Clarke Bail for his appearance for the

Debt in the Declaration mentioned and costs.

16 Sep 1772 -- Minute Book 1, page 76: William Blair Plft. against

William Snodgrass Deft. This day came the Parties by their attornies

and the Plaintiff joined the Defendants in their Plea which they

Plead at the Last Court and the Trial of the Issue is Referred

till the next Court.

16 Sep 1772 -- Minute Book 1, page 84:

Joseph Snodgrass Plt. against Robert Jones Deft., in debt.

This day came the Plaintiff by his attorney and the Defendant tho

solemnly called came not but made Default Therefore it is considered

by the court that the Plaintiff Recover against the said Defendant for

fifty pounds and Walter Clarke Bail for his appearance and his Costs

by him about his suit in this behalf expended and the Defendant in

mercy &c But this Judgement is to be discharged by the payment of

Eleven pounds fourteen shillings with Interest thereon to be

computed after the Rate of five percent ___ from the 1st Day of

December 1771 till paid and the costs.

[vss - here it is! From a xerox I rec'd in 1993 from Jorja Hensley

of Townsend MT - she rec'd it from SCS member Frances Snodgrass

Brown of Chickamauga, GA, and it was with a partial copy of book

by Thomas Howe R. Neal "The Neal, Harbison, Snodgrass, Miller and

Related Families" (1971) ... the front page of the book has the

name Mrs. Charles F. Saul, Bristol, TN, written as if the book

belonged to her ... in any case, the Glenn will is two pages typed -

it was notatrized 12 Sep 1968 by Christine Bergen,

800 Winchester Ave., Martinsburg, WV (verify, she may have been

a Berkeley Co Court Clerk)

IN THE NAME OF GOD, AMEN, I JAMES GLENN, tailor, being weak

in Body but of Sound mind Blessed be God, and calling to mind the

mortality of my Body, and knowing that it is appointed for all men

to die do make and ordain this my last will and testament, that is

to say, in manner following, first I give and bequeath & recommend

my Soul into the hands of Almighty God, and my body to the Earth

to be burried in decent Christian burial at the discretion of my

executors and as touching my worldly Estate wherewith it hath

pleased God to bless me in this life I give and bequeath in form

and manner following, viz. [vss - ITEM ?] I give and bequeath to

my eldest son John Glenn a young negro boy named Dick ITEM I give

and bequeath to my second son James Glenn a negro man named Tamm

and to his heirs. ITEM I give and bequeath to my third son William

bequeath to my eldest daughter Jane Miller during her lifetime, a

young negro wench named Dinah & then at her decease to her son James

Miller and his heirs forever. ITEM I give and bequeath unto my

second daughter Margaret Snodgrass, and her heirs a negro woman

named Luce [vss - possibly Lucy ?], likewise I give and bequeath

unto my Beloved wife Martha Glenn the remainder of my Estate to be

disposed of by her as she shall think fit, my funeral charges being

first discharged, with all my just debts. And also I make ordain

and appoint my Beloved wife Martha Glenn and my son William Glenn

to be my sole executors of this my last will and testament, to adjust

this my estate as before devised. And I do disallow, revoke and

disannul all and every other wills Testaments and Dowers, ratifying &

confirming this & no other to be my last will and testament.

19 Aug 1774 beginning for the said granted and demised premises at

a marked white oak in the old original line S 39 W 163 poles to a

marked white oak corner to the Old Tract then N 51 W 147 poles to a

place near a marked poplar on the side of Elk Hill then N 39 E 163

to a corner Chestnut Poplar and white oak then S 51 E 147 poles to

the beginning containing 150 acres more or less... paying the

Common Wealth of Virginia and Parish of Norbourne being at

preseant Though weak in Body yet in perfect mind and memory and

Calling to mind the uncertainty of this Mortall life and that it is

appointed for all men once to die and after death to come to

Judgement do make and ordain this my last will and Testament in

manner following: first and Principally I recommend my Soul to

Almighty God my Creator who gave it me and my Body to the Earth

from whence it was taken to be buried in a Christian like manner

at the discretion of my executors hereafter mentioned and as for

such Worldly goods and chattels as it hath please God to bless me

County of Berkeley and commonwealth of Virginia being in a poor state

of health at present but of sound mind memory and judgment thanks be

to God therefore calling to mind the mortality of my body and the

uncertainty of this present life and that it is appointed for all men

once to die do make this my last will and Testament in manner and form

following principally and first of all I Recommend my Soul unto the

hands of Almighty God my Body I Recommend to the Earth to be buried in

a decent Christian manner at the discretion of my Executors nothing

doubting but at the General Resurrection I shall Receive the same by

the mighty Power of God and as to such Worldly estate wherewith it has

pleased God to bless me in this life I give and bequeath (after my just

aforesaid Division lines to extend from Col. Pendletons line &

intersect the line above the meadow called the mountain Meadow the

part adjoining Frederick Heffners lands on both sides of Tuscarora to

be my son William Snodgrass part the other two shares to fall to my

two sons Benjamin Snodgrass and James Snodgrass to be determined by lot

where the share of which the Mansion House stands shall be if the cannot

agree otherwise the above mentioned land with all the appurtenances

thereto belonging to be by them their Heirs and assigns possessed and

enjoyed seperately forever but is my Will and pleasure further that if

my son William doth loose the house he now lives in by the above said

Division that all the Building on the premises shall be valued by men

that whosoever of my other sons the do fall unto shall assist him in

Building Equivalent to the value thereof or pay him the third of the

value thereof as he shall chose I give and bequeath to my son John

Snodgrass all my wearing apparel my Bed and furniture and I allow my

other three sons William Benjamin and James Snodgrass to pay to him

my said son John Snodgrass the sum of three pounds apeace yearly and

every year during his natural life which sum of nine pounds is to be

for his yearly support while he lives and likewise to keep for him a

Horse for him to Ride on I give and bequeath to my Daughter Elizabeth

wife of Samuel Kennedy the sum of Twenty Shillings she having before

Received all that I allowed her I give and bequeath to my daughter

Catharine Snodgrass one Horse worth fifteen pounds Currency likewise

her Saddle and bridle a Bed and Bed clothes Two Cows one Calf five Sheep

nevertheless but if she my said Daughter Catharine Marry before my Decease

my will is that the Legacy shall be and as I intend at that time to give

her what I allow for her portion and she shall be entitled to no more than

Twenty Shillings equal with her other sisters after my Decease I give and

bequeath to my Daughter Sarah wife of William Eakin the Sum of Twenty

Shillings the Remainder of my personal Estate I allow to be Equally divided

between my sons John Benjamin and James Snodgrass and I do hereby make

Constitute and appoint my Two Sons Wm. and Benjamin Snodgrass together

with Samuel Kennedy to execute this my last Will and Testament and I do

This last will and Testament of John Snodgrass deceased was presented

in Court by Samuel Kennedy William Snodgrass and Benjamin Snodgrass the

Executors therein named who made oath thereto according to Law and the same

being proved by the oaths William Glenn Mary Reany and John McClean witnesses

thereto and ordered to be Recorded and on the motion of the said Executors who

entered into Bond with William Glenn and John Kennedy their Securities in the

Penalty of five hundred pounds conditioned for the true performance of the

administration of the said Estate certificate is granted them for attaining

a probate thereof in Due form of Law

would indicate that this John Sr. was born by 1730. Since his son John Jr.

Vol 2, pp 135:

Tate vs. Bedinger--O. S. 163; N. S. 57--Bill in Berkeley County, July, 1797, by

Magnus Tate, Jr., and Elizabeth, his wife, late Elizabeth Strode, widow of James Strode,

deceased. In 1794 Strode gave a tract to his son-in-law, Henry Bedinger, and made a deed

which it is sought to set aside as fraudulent. Henry was member of legislature in 1794.

Answer says in fall of 1794 Henry was informed of precipitate marriage of James Strode,

aged 68, to Miss Fryatt (now Mrs. Tate), aged 19. Copy of the deed.

James Strode's will of Berkeley County. Daughter, Susannah Magowan; land in Fleming

County, Kentucky. Grandson, James Magowan; daughter, Eleanor Shepherd; daughter, Rachel

Bedinger; sons, James, John (lands near Strode's Station in Kentucky); daughter, Anna,

lands in Ohio County; granddaughter, Eleanor Swearingen; granddaughter, Nancy Magowan;

daughter, Phebe Swearingen, deceased. Dated 20th February, 1795.

Recorded in Berkeley 28th April, 1795.

Nancy Snodgrass (formerly Nancy Fryatt), deposes in Berkeley County, 26th November,

1798. Elizabeth Tate is daughter of John Fryatt, of Berkeley. Nancy Snodgrass is sister

of Elizabeth.

Abraham Shepherd deposes that in December, 1794, James Strode married Elizabeth. He

had then living by his first wife, three daughters, Susannah, Eleanor, Rachel; and by a

second wife, two sons and a daughter. Susannah married James McGowan. Eleanor married

deponent. Rachel married Henry Bedinger. Children by second wife were small children, the

eldest about 7 years, the youngest about twenty months. James Strode died 7th March, 1795.

Whites Branch and on the East Side of Dirt Hill Mountain in said county of

Berkeley Beginning at a chesnut tree, and 2 chesnut oaks corner to Robert

Pinkerton, thence reversing his line S 16 degrees 90 minutes W 78 poles to a

chesnut oak in the line corner to Konickes ? lands Thence with his line N 74

degrees 30 minutes W 78 poles to a stooping chesnut oak on the side of the

aforesaid mountain then leaving the line N 5 E 150 poles to a white oak on

the side of the mountain thence N 58 E 22 poles to a hickery by a large rock

corner to said Pinkerton finally reversing his line S 32 degrees 30 minutes E 128

highest bidder, for CASH, a TRACT OF LAND situated in the county of Fayette, Ohio, between the

farm houses, &c.

In the name of God Amen. I Robert Snodgrass of the County of

Berkeley and State of Virginia, Knowing the uncertainty of life and

the

certainty of death, and feeling myself now in a sound state of mind

and

capable

with satisfaction to myself of disposing of my property, do publish

and

declare

this to be my last will and testament, hereby revoking all wills of a

prior

date.

1st It is my will that all my just debts and funeral expenses be

paid

and to this affect I earnestly desire my executor to avail himself of

my

earliest funds to pay off and satisfy my creditors.

2dly I give and bequeath to Sarah Ann Snodgrass in addition to

the sum

of

two thousand ($2000) dollars already advanced to her, all the right,

title

and

interest which I have in the lands of Samuel Hedges dec'd which I

purchased of

William B. Hedges and Hezekiah Hedges assignees of Bailey T.

Hedges,

and I

further give and bequeath to her the further sum of two hundred

dollars in

Cash.

3dly I give and devise to my daughter Elizabeth Hedges in

addition to

the

sum of seven hundred and twenty two dollars ($722) already

advanced to

her,

all my lands in the County of Morgan to her and her heirs forever

and I

further give & bequeath to my said daughter Elizabeth the further

sum of

eighteen hundred and twenty eight dollars to be paid to her by my

executor

in

good solvent paper, the one half of said sum to be paid as aforesaid

in one

year and the balance in two years after my death. But my executor

is

authorised at his discretion to pay the said legacy sooner and in cash

if the

situation of my estate will allow him to do so.

4th I give and bequeath to my daughter Mary T. Evans, in

addition to

the

sum of twelve hundred and two dollars already advanced to her, the

futher

sum

of one thousand and ninety eight dollars to be paid to her by my

executor

in

cash the one half in one year & the residue in two years after my

death, But

as before stated in reference to the legacy to my daughter Elizabeth,

my

executor is authorised and indeed desired to pay the above

mentioned

legacy to

my daughter Mary earlier if the situation of my estate will allow him

to do

so.

5thly I give and bequeath to my wife Catherine Snodgrass,

during the

term

of her natural life, the profits and dividends of my bank stock and

canal

stock, also during the said period of her natural life, the one third of

my

personal property, & negroes and also the one third of the rents and

profits

of all my lands & houses in the county of Berkeley and in as much as

I

have

given her during her life, the full enjoyment of the whole of my

interest in

my Bank & Canal Stock, supposing that such interest in addition to

the

above

bequests will be equivalent to the one third of my whole estate,

should my

wife Catherine amend the provision of my will & claim her legal

distribution

rights, it is my wish that each of my daughters above mentioned shall

have

deducted from their legacies the sum of one hundred & fifty dollars,

and in

that event that my bank stock & canal stock (excepting my wifes

interest

therein) be equally divided & distributed among all my children and

should

my

wife accept the provision made by this will for her, it is my desire &

she is

hereby invested with full power at her death of making by will such a

disposition of that portion of my personal estate left to her during life

among my children as she shall deem most proper & judicious.

6th It is my will that the bond which I hold on Jefferson Evans my

son

in

law be given up to my daughter Mary to be by her cancelled or

otherwise

disposed of at her pleasure.

7th I devise to Hezekiah Hedges in trust and for the use and

benefit of

Robert Reeds [Reed], an orphan Child raised by me, a tract or parcel

of

land, of

fifty acres, subject to the limitation hereinafter expressed, to be

taken from

a tract of 166 acres purchased by me of Thomas Hammond

Executor of

James

Hammond dec'd & part of a tract of 85 acres which I located &

patented

myself.

The said tract to commence nine rods below Tunis fords, thence

down the

meanders of Back Creek to a corner near the mouth of a deep

gulley,

corner to

the tract of 166 acres bought of Hammond, thence along a line of

marked

trees

north 72 W 74 poles to a white oak on a hill thence pursuing the

calls of

the

two tracts above refered to until the quantity of 50 acres are taken

off. But

should the said Robert Reed die without leaving a legitimate child or

children,

then in that event the said tract to revert to my heirs at Law. It is

understood

that this tract of 50 acres is to be subject likewise to the claim given

by me

to

my wife to the one third of the profits of all my lands in the County

of

Berkeley.

8th I devise and bequeath to my son Joseph Snodgrass all the

rest and

residue or my real and personal estate of every kind, wheresoever

found or

situated, not otherwise disposed of by this will.

9thly whereas I have a number of small claims under five dollars

due to

me by persons of poor circumstances in the neighborhood, it is my

desire

that

my executor shall exercise his discretion as to the collection of those

claims

taking care not to exact strict justices when the collection of such

small

claims will operate with any hardship or oppression.

10thly should it happen that any of my daughters should receive

any

additional advancements after the date of this will, which sums shall

appear

charged on my Books in my hand writing or for which receipts shall

be

given,

then several sums are to be first deducted from the Legacies left to

them in

the previous sections of this will before their legacies are given to

them by

my executor.

11th Lastly I do hereby nominate, constitute and appoint my son

in law

Robert H. Snodgrass [Robert V. Snodgrass] the executor of this my

last

will & Testament.

bedsteads, and bedding as they now stand in the white room, also

the

Bureau

that is in the said white room, and I further give and devise unto my

daughter

Mary Snodgrass one sett or half dozen large silver spoons.

Secondly I give and devise unto my daughter Susan R. Henshaw

the

wife of

Thornton Henshaw the other bedstead and bedding as it stands at

present

in the

white Room, also the large Gilt framed mantle Glass that I now use

in my

parlor and further the rug and fire furniture, that is to say the large

brass

and Irons brass fender, Shovel, tongs and tong hooks now used in

my

parlor,

and I further give and devise unto my daughter Susan R. Henshaw

my

large

Family Bible that has the name of John F. Snodgrass upon the back:

are

special articles that I wished my two daughters to have in the order

in

which

they are named. And as to the rest, residue and remainder of my

effects

herein before bequeathed or disposed of, subject to all the charges

disposing mind and memory do make ordain and publish my last will

and

Testament in manner and form following Viz 1st I direct my

Executor

hereinafter named to sell at such time as he may deem expedient all

my

perishable property not hereinafter specificallly bequeathed. 2 I

give and

bequeath to my beloved wife Elizabeth all the furniture in and about

my

house

and Kitchen or so much thereof as she may desire to have, to hold

and use

during her life and I direct my executor to sell the same after her

death the

proceeds to go into my estate 3 I give devise and bequeath to my

said

Wife

Elizabeth the house garden and yard where I now reside, to enjoy,

use and

occupy so long she desires to do so, but if at any time she should

move her

residence therefrom then I direct the said premises to be disposed of

as the

remainder of the farm on which they are situated. 4th I give devise

and

bequeath to my said wife Elizabeth for and during her natural life

one full

third part of the rents, profits, and hires of all the real estate and

slaves

of which I may die seized and possessed 5 I direct my executor to

rent out

all of my real estate and hire out all of my slaves until my youngest

child

shall arrive at the age of twenty one years, the proceeds after paying

to my

wife the amount before provided to be divided equally among my

children,

provided however that in every annual distribution such of my

children as

shall be under the age of eighteen years shall receive each twenty

five

dollars more than those who shall have passed the age of eighteen 6

hereby

authorize my executor to sell any of my slaves at public or private

sale

whenever in his discretion it shall seem to him most prudent safe and

expedient to do so, the interest of one third of the proceeds of such

sale to

be paid annually to my wife during her life 7 I give and bequeath to

my

wife

Eliabeth two milch cows to be selected by herself also a side saddle,

bridle

and equipments 8th I give and bequeath to my son William my

riding

saddle,

bridle and equipment 9th I give and bequeath to my son Isaac

riding horse named Dick, the saddle which William now uses and a

10 I give and bequeath to my son John Breathed my silver

patent-lever

watch 11 If my death should occur at a time inconvenient for

renting my

real

estate or hiring my slaves I authorize my executor in his discretion

to keep

my estate together and put in corps until such time as he may deem

it

expedient to rent the lands and hire the slaves 12th all the rest and

residue

of my

estate of every description I give and devise to be equally divided

among

my

children when the youngest shall arrive at the age of twenty one

years, at

which time dower in my lands and slaves shall be assigned to my

wife in

lieu of

the annual payments before provided for, and I would advise my

wife and

children

to join in a sale of the real estate at that time 13 I hereby declare the

provisions made in this will for my wife to be in lieu of Dower in my

real

estate and slaves, and of her right to a third of my personal Estate.

14 In case a child shall be born to me after my death it is my will that

such child share the provisions of this will as if now in being, and in

the

event

of any of my children dying leaving issue before the final division

and

distribution of my Estate, the issue of such child or children so dying

shall

have

the portions respectively designated herein to the respective parties

of

such issue. 15 I nominate constitute and appoint my Brother

William T.

Snodgrass executor of this my last will and Testament and guardian

of all

my

children In Testimony whereof I have hereunto set my hand and seal

8 Mar 1858 -- Will Book 21, pages 56-58:

In the name of God, Amen. I, Robert V. Snodgrass of Berkeley

County, Virginia, being infirm in body, but of sound mind &

disposing

memory do make this my last will & testament in manner and form

following,

"That is to say"

First after the payment of all my just debts and funeral expenses,

which

I hereby direct my executors herein after named first to pay out of

my

estate,

I will and bequeath to my beloved wife Sarah Ann one third of my

estate

both

real & personal to hold and enjoy & dispose of the personal estate as

she

shall deem proper, either by will or otherwise.

Second The remaining two thirds of my estate both real and

personal

together with the reversion in my real estate, which I have willed to

my

said

wife Sarah Ann during her life, I hereby will and bequeath as follows

that is

to say to my children viz. Catharine Elizabeth, Sarah Ann, Susan

Pendleton,

Stephen, Mary Louisa, Hannah Ellen, Robert V., Fanny Bell, &

William,

each one

tenth part of my estate aforesaid and to William T. Snodgrass,

whom I

hereby

nominate and appoint as trustee, I will & bequeath one tenth part of

my

estate

aforesaid to hold the same for the use & benefit of my daughter

Lucinda

Virginia or her children during the natural life of her husband Elliott

R. W.

Tabb which trust shall terminate at his death and the title which is

herein

invested in William T. Snodgrass the trustee aforesaid shall

immediately

cease

and become at once vested in my said daughter Lucinda Virginia and

her

children forever--The whole of my estate herein willed to my

children and

to

William T. Snodgrass in trust shall be and is hereby charged with an

annuity

of sixty dollars a year which I hereby devise to my mother Elizabeth

Snodgrass

during her life to be collected by my executors herein after named

and paid

to

her quarterly.

Third In ascertaining the shares to which each of my children

shall be

entitled under the second clause of this will including that portion

willed to

William T. Snodgrass in trust for the benefit of my said daughter

Lucinda

V. I

direct that the following advancements shall be taken into account

and the

respective shares of those of my children to whom such

advancements

have been

made shall be charged therewith--the said advancements are not

however

to be

regarded or treated by my executors as personal estate but are

referred to

here solely for the purpose of equalizing the shares of those of my

children

who have received nothing with those to whom advancements have

been

made,

that

is to say: I have advanced to Catharine Elizabeth seven hundred and

seventy

eight dollars, to Sarah Ann, Five hundred and twenty-eight dollars,

to

Lucinda

V. Five hundred and twelve dollars, to Susan Pendleton Five

hundred and

twenty

six dollars, to Mary Louisa Five hundred & forty seven dollars and to

Stephen

Three hundred dollars, which advancements as aforesaid are to be

taken

into

account and to be considered in making a division of my estate

among my

several children herein before named and the trustee for my daughter

Lucinda

Va.

And lastly I hereby constitute and appoint my friend Wm. T.

Snodgrass

and

my son Stephen Snodgrass Executors of this my last will &

testament.

In witness whereof I have hereunto set my hand and affixed my

seal this

8th day of March in the year 1858.

June 25th 1860 This my first codicil to my will is made--I desire

that

my slaves of which I may die possessed shall never be sold by my

executors or

heirs to go out of the County of Berkeley Va. (They are well

disposed) If

any

of my children to whom they may fall in the division of my estate

choose to

take them to reside with them in any of the adjoining Counties they

may do

so,

but if they want to sell them they must find a master for them in the

County

of Berkeley, who will enter into an agreement with good security in

an

amount

equal to the value of the servants, to faithfully carry out these

provisions &

conditions. I hope that none of my children will want to disregard

this my

will and desire and I beseech them to cooperate to have my wish

carried out

fully.

July 24, 1860 This my 2nd codicil is made to my will above,

First I

will

and direct that my executors in making up the account of Elliott R.

W.

Tabb's

indebtedness to me shall not charge him with the sum of six hundred

dollars

due by note assigned me by Stephen Snodgrass, it having been

secured to

be

paid by the deed of trust on his Tabb's land dated 13 February 1857

as the

said debt has been cancelled & settled by and between the parties,

Neither

is

said E. R. W. Tabb to be called to account or charged with the sum

of

three

hundred dollars due by note bearing date, 15th July 1855 payable to

me

and

secured by Trust Deed from said Tabb to Wm. T. Snodgrass trustee

given

on his

household goods, cows and sheep dated 3rd June 1856 as the debt

has

been

cancelled and otherwise settled. Witness my hand & seal

Codicil third I Robt. V. Snodgrass do make this my 3rd codicil to

the

foregoing will, annulling and revoking so much of the said will as

bequeaths

to my daughter Susan P. wife of Jacob Thomas the one tenth part of

my

estate

real & personal together with the one tenth of the reversion in the

estate

willed to my wife Sarah Ann and in lieu thereof I will and bequeath

the

same

to Wm. T. Snodgrass whom I nominate and appoint as trustee for

the

purpose, to

hold the same in use for the separate use & benefit of my said

daughter

Susan

Pendleton Thomas or her children during the natural life of her

husband

Jacob

Thomas, which trust shall terminate at his death & the title which is

here

invested in the said Wm. T. Snodgrass shall cease and the estate

become at

once vested in the said Susan P. Thomas & her children forever

October 3rd 1860 I this day make this my 4th codicil to wit that

the

advancement charged in the will to my son Stephen must be only

two

hundred

dollars instead of three hundred dollars as therein named, I have

discovered

that part of the property charged as advancement had been settled

At a court held for Berkeley County January Term 1861 The last

will and

testament

and codicils of Robert V. Snodgrass deceased was produced in

court and

proven

by the oaths of David H. Conrad and John P. Kearfott Esq. to be

wholly in

the

hand writing of the testator and is ordered to be recorded. And on

the

motion of

William T. Snodgrass and Stephen Snodgrass the executors therein

named,

who

made oath according to law and entered into separate bonds each in

the

penalty

of

six thousand dollars conditioned according to Law certificate is

granted

them for

obtaining a probate in due form.
