Nursery and Seed Registration

Below is the information regarding the registration of Nursery and Seed in Colorado. There are Acts that require registration and even Conservation Districts must comply. Many of you already are registered, but if your Conservation District is fairly new to selling trees/seed or if you are unsure it is best to confirm registrations are up-to-date. SEED

Seed is alive. It must be handled and protected against conditions that will harm it and reduce its ability to germinate. If the seed does not germinate and grow, it has no value. The Colorado Seed Act (35:27) requires that anyone who sells seed in the state of Colorado be registered and that all seed be labeled. Selling includes cost-share of seeds with landowners. Seed laws in Colorado provide consumer protection and regulate truth in labeling.

Registration

Registration requires annual renewal and penalties may be given to entities that do not register on time every year.

NURSERY

The Colorado Nursery Act (35:26) protects consumers and the environment from the movement of invasive pests and disease introductions. Nursery stock is a high risk vector for the spread of pests, diseases and noxious weeds that may be harmful agriculture and the environment.

Registration

Anyone who sells or advertises with the intent to sell nursery stock in the state of Colorado must be registered. This includes nurseries, sod farms, retail garden centers, landscape contractors, and not-for-profit organizations who distribute nursery stock. Conservation Districts are categorized as ‘body politic’ in the Nursery Act and are required to register as a nursery when selling trees and other nursery stock. However, there is no registration fee for those classified as ‘body politic’. Though there is no fee for Conservation Districts, Districts must file a registration renewal form annually to maintain compliance under the Colorado Nursery Act.
