Supervisor Workmen's Compensation Exemption

As part of the special districts, Conservation Districts must either provide workers' compensation insurance for board supervisors or file for an exemption for such coverage with the Colorado Division of Workers Compensation. (C.R.S section 8-40-202(1)(a)(I)(B)) The exemption form must be filed with the Division of Workers’ Compensation not less than forty-five (45) days before the start of the policy period for which the option is to be exercised.

Thus, if board supervisor workers' compensation is not purchased, this must be done every year to remain in legal compliance. The form (WC44) is obtained from the Division of Workers' Compensation. If your Conservation District has workmen's compensation for Board Supervisors, you do NOT have to file anything; just be sure to have copies of the policy on hand.

**Be sure that you have accurate insurance descriptions (district managers, DCT employees, and board supervisors are all different class codes).


To file an exemption for the board:

Fill out the WC44 Exclusion of Uncompensated Public Officials form provided by the Division of Workers' Compensation. WC44 is a Google Form and can be accessed at the link below:

Upon completion, a copy of your responses will be emailed to you at the address you provided. If insured, provide a copy of the responses to your insurance carrier.
