A local municipality can make or break a project with its regulations. It is important for the developer to identify the needs of the city and present his finding in a way that will prove mutually beneficial to his project and the welfare of the community. Even for smaller development projects like my case study, building code and variances ordinances can alter the project plan. It is important to have a good relationship with the city's planning department as well as council members that may eventually sway a legal decision in my favor.
Below I am including two MOUs, one my course work in my Due Diligence course (LDEV 687) and the other an actual MOU I submitted to a developer who was seeking to execute a development plan for a mixed-use community in Bryan, Texas. During the due diligence phase of a program it is vital for the developer to understand the zoning ordinances as well as any entitlements necessary for his or her site plan to earn approval from City Council.
