Evaluate the law and contract provisions that impact and secure property value with respect to property rights and obligations, public private partnerships, conveyance, ownership structure, leases, liens, mortgages, property finance, rights of way, easements, covenants, and other legal and contract provisions.


In dealing with property law and contracts, the MLPD program taught me how land conveys based on the type of deed involved in the transaction. Moreover, an understanding of the law is required in order to effectively complete your due diligence. Especially within the entitlement process where zoning laws and deed restrictions can make or break your deal. In the long term, I have an interest in land speculation, so I took a special interest in the discussion related to annexation. Below is an assignment based on the landmark Nollan and Dolan United States Supreme Court cases, which speaks to legal concerns as it relates to cities annexing land and a developers rights and desires. These two cases at a time set limits on governments’ ability to impair property interests with land use regulations. Under those decisions, there must be a “nexus” and “rough proportionality” between the government’s demand and the effects of the proposed land use.
