Project 5B

Artículo 1. Esta Ley se fundamenta en los siguientes principios:

1. Prohibición de toda discriminación basada en el sexo: igualdad ante la ley y demás derechos individuales y sociales, y garantía fundamentales que se consagra la Constitución Política que obliga al Estado a legislar sin discriminación y a aplicar igualitariamente las leyes a las personas individuales y a los colectivos.

2. Garantía de los derechos básicos de las humanas e igualdad de trato y oportunidades de desarrollo social. Contemplados en la Convención de las Naciones Unidas sobre la Eliminación de todas las Formas de Discriminación contra la Mujer, que obliga al Estado a condenar la discriminación de género y a establecer políticas públicas para eliminarla.

3. Condena de todo tipo de violencia contra las mujeres contemplada en la Convención Interamericana para Prevenir, Erradicar y Sancionar toda Clase de Violencia contra la Mujer, y que obliga al Estado a proteger a este sector social de los actos violentos, violatorios de sus derechos humanos.

4. Protección de los derechos humanos y garantías fundamentales de las niñas y niños establecidos en la Convención sobre los Derechos del Niño, que compromete al Estado a tomar las medidas apropiadas para garantizar la protección a la infancia sin discriminación.

5. Equidad, justicia y respeto a la vida humana, consagrados en la Declaración Universal de los Derechos Humanos.

6. Respeto a los derechos que consagran las diversas legislaciones nacionales y declaraciones y conenciones internacionales, sobre la materia.

Article 1. This Law is based on the following principles:

1. The prohibition of all discrimination based on sex: equality before the law and other individual and social rights, and fundamental guarantees enshrined in the Political Constitution that obliges the State to legislate without discrimination and to apply laws equally to individuals and collectives.

2. The guarantee of basic human rights and equality of treatment and opportunities for social development, as contemplated in the United Nations Convention on the Elimination of All Forms of Discrimination Against Women, which obligates the State to condemn gender discrimination and to establish public policies to eliminate it.

3. The condemnation of all forms of violence against women, as contemplated in the Inter-American Convention on the Prevention, Punishment, and Eradication of Violence Against Women, which obligates the State to protect this social sector from violent acts that violate their human rights.

4. The protection of the human rights and fundamental guarantees of children, as established in the Convention on the Rights of the Child, which commits the State to take appropriate measures to ensure the protection of children without discrimination.

5. Equity, justice, and respect for human life, enshrined in the Universal Declaration of Human Rights.

6. Respect for the rights enshrined in various national legislations and international declarations and conventions on the matter.
