COURSE DESCRIPTION
Obtaining a judgment does not automatically entitle a successful claimant to the debtor’s financial assets or property for claim satisfaction. This course explores the legal framework for enforcing judgments by unsecured creditors, with a focus on the specialized procedures required to collect monetary judgments. Through a detailed examination of the Civil Enforcement Act of Alberta, students will gain insight into key enforcement mechanisms, including:
Prejudgment remedies
Registration and priority of writs
Enforcement against personal property
Enforcement against land
Garnishment
Distribution of proceeds of enforcement
The course also explores provincial laws on fraudulent conveyances and preferences.
