HANGING & PLACEMENT OF ITEMS IN THE COMMON AREA

The following ACC recommendation has been adopted by the Kinney Village HOA Board for implementation as the community emerges from the “remodel” process.

After each building in the community has had its stucco repaired and the painting is completed, the committee recommends:

a. No nails, hangers, screws or any fastener that would compromise the integrity of the stucco can be used on exterior common walls. (See “c” below for definition of common areas.)This will protect the building and will help preserve the extended paint warranty the community is getting with the work that is being done. If an owner chooses to use fasteners that compromise the stucco of porch walls and Arizona Room walls (considered within the footprint of the building) the owner will be responsible for any maintenance or repair caused by such fastener.

b. No objects will be allowed on any stucco ledges. This action will also protect the stucco and the paint.

c. Common areas are defined as any area outside of the footprint of each building. (Porches and Arizona Rooms are considered within the footprint of the condo.)This was confirmed by research on the Pima County website with a review of the plats. In any common area unit owners must complete and formally submit an Architectural Control Committee Submittal Form if they wish to insert any object including pavers, yard art, furniture, birdbaths, etc. No plastic furniture, children’s toys or other plastic objects will be allowed. Requests submitted by non-owners will be denied. Even though the porch area and Arizona room are not common areas, the HOA still maintains control over items that are visible from the exterior, as delineated in the CC&R’s, Article IX, Section 9.2.

a. Any member of the ACC that submits an Architectural Control Committee Submittal Form for their residence will not be allowed to vote on the modification.

The architecture of Kinney Village is Mediterranean. We recommend that owners consider impact on common areas with this in mind.
