RE: "ABOVE GROUND POOL" DEFINED
The CSA's protective covenant against "above ground pools" (Article VII, Section 9(s)) and the emergence of pool products that blur the distinction between children's wading pools (permitted under Standing Resolution) and above ground pools (prohibited by covenant) gives rise to this Information Bulletin which defines an "above ground pool".
For purposes of the CSA Declaration an "above ground pool" is defined as a pool having any of the following characteristics:

Whereas the EPCOM and Community Association (CSA) Board of Directors regard the addition of hot tubs, lap pools, and exercise pools as being consistent with the design aesthetic and outdoor lifestyle desired by CSA members,
Whereas designs of hot tubs, lap pools, exercise pools and the like, for homes in the Back Creek Landing are required to be submitted for approval by the CSA Environmental Preservation Committee (EPCOM),
Whereas the installation of hot tubs, lap pools, exercise pools and the like should include all of following guidelines:
Placement
Hot tubs, lap pools and exercise pools must be located on rear decks or in rear yards only. They should be located close to the rear wall of the house. Talbot County regulations require tubs/pools must not be any closer than ten (10) feet to the side property line, twenty-five (25) feet from the rear property line.
Drainage
Hot tubs, lap pools and exercise pools must not be drained in a manner that adversely affects water run-off to neighboring properties and/or the common land owned by the Back Creek Landing Community Service Association. Chlorinated water from a hot tub, lap pool, and exercise pool must be de-chlorinated before it is drained on to a homeowner's property. Water in any hot tub and/or pool in excess of 750 gallons must be removed by a swimming pool service provider.
Security
Covers to tubs and/or pools must have locks and be kept locked when not in use. It is suggested that homeowners contact their homeowner insurance carrier for further requirements.
Privacy Fence and Landscaping
To be assured that a hot tub, lap pool, exercise pool and the like is less intrusive to your neighbors, privacy fencing, landscaping along with the screening of filters, pumps, heaters, and other related equipment should be provided.
Building Permit
Responsibility for conforming to any applicable zoning permit and building code requirements of Talbot County rests solely with homeowners on whose lot tubs/pools are to be installed. Talbot County regulations/requirements supersede the BCLCSA covenants.
