Standing Resolution - On-Lot Basketball Goals

Whereas the installation of basketball goals, whether permanently installed or temporary, is subject to regulation and approval by the Back Creek Landing Community Service Association (CSA) Environmental Preservation Committee (EPCOM) and
Whereas the EPCOM is authorized by the CSA Declaration of Protective Covenants to adopt a Standing Resolution that permits the installation of such recreational structures without the necessity of securing a formal EPCOM approval for each such installation, if located installed and maintained in accordance with the guidelines of a Standing Resolution adopted by the EPCOM,
Now Therefore Be It Resolved that basketball goals may be installed within the yard of any home, without the necessity of securing formal EPCOM approval provided that:
- If located in other than a rear or side yard, the goal, where permanent or temporary, shall be situated either at the driveway turning/back-around area, if such exists, or if located on a driveway not having a back-around area, the backboard shall be no more than 15 feet in the front of the house garage door.
- Any backboard, related supports and rim, shall be maintained in a well painted condition at all times, free of peeling paint and rust, components shall be properly aligned and nets intact.
- Any backboard, supports and rim that are not well maintained and painted, are bent or "out of plumb", have broken parts, a shredded net, or otherwise are in disrepair and remain so following 30-days notice from the EPCOM shall not be permitted to remain installed and the CSA shall be entitled to enter onto the owner's property to have the non-complying installation removed, the cost of such removal being charged to the member.
- No backboard shall be located in a front yard except on a driveway as delineated above and no backboard, permanent or temporary, shall be located at the curb or front property right-of-way line, so that play occurs within the public streets.
- On-lot backboard installations are permitted subject to the rights of neighbors to the quiet enjoyment of their property not being disturbed. "Quiet Enjoyment" dictates that use of backboards cease at dusk and that basketball games not involve the use of loud or obscene language. Anyone relying upon this Standing Resolution for installation of a basketball goal understands and agrees that the use of basketball goals in a manner that interferes with the quiet enjoyment of neighbors as set forth above will result in the EPCOM causing the offending facility to be removed as a nuisance.
