Standing Resolution - Lawn Statuary

Whereas the addition of any item or feature to the exterior of any home or yard area within the Back Creek Landing community is subject to regulation and approval by the Back Creek Landing Community Service Association (CSA) Environmental Preservation Committee (EPCOM) and
Whereas the EPCOM is authorized by the CSA Declaration of Protective Covenants to adopt Standing Resolutions that facilitate members accomplishing certain modifications to their homes and lawn areas without the necessity of requesting formal EPCOM approval and
Whereas the EPCOM desires to permit the inconspicuous placement of unobtrusive lawn statuary within the yard of any home,
Now Therefore Be It Resolved that the placement of lawn statuary is permitted in the yard of any home, without the necessity of securing formal EPCOM approval, subject to the following:
- If the statuary is a bird bath, the bird bath shall be of stone, clay, concrete, metal, or natural earth tone color or may be colored white or black.
- For single lawn statuary other than a bird bath, the statuary shall:
- not exceed 18 inches in height
- be made of concrete, metal or clay material ( no plastic)
- have natural, unpainted finish
- if located within a front yard, be located no more than 10 feet away from the front porch
- if located in a back yard, be located no more than 5 feet away from the house or any attached deck or porch structure
- if located in a side yard, be located no more than 5 feet from the house
- for more than one lawn statuary, the homeowner should submit request for approval from EPCOM in writing
- for lawn statuary not meeting the other descriptors here, the homeowner may submit request for formal EPCOM approval in writing as well.
- all such lawn ornamentation shall receive edge trimming at the base of lawn statuary as part of the homeowner's regular lawn maintenance, and shall be kept in an attractive, well-maintained condition.

- if the statuary is a bird bath, or "gazing ball" and pedestal, the bird bath or gazing ball shall be of stone, clay, concrete or natural earth tone color or may be colored white or black
- for lawn statuary other than a bird bath or gazing ball, the statuary shall:
- not exceed 18 inches in height
- be made of concrete or clay materials ( no plastic)
- have natural, unpainted finish
- if located within a front yard, be located no more than 5 feet away from the front yard foundation planting border
