The annual assessment of membership dues is based upon a calendar year. The dues are based upon the currently approved annual amount of $45.00 per calendar year. The invoices for dues will be distributed by the 15th of December for the subsequent year and are payable by January 31st of the dues year. Any member who is delinquent will have the greater of $20 or 10% of the total amount due, including prior late fees, assessed a late fee penalty on February 1st of the dues calendar year unless the first is on a Sunday which will be February 2nd. For those payments received via USPS mail, the postmark date is considered as the date of receipt. For all others, the payment must be posted to the BPOA financials institution prior to that date to avoid a late fee assessment.
New members are assessed $45.00 if they join between January 1st and June 30th or $22.50 between July 1st and December 31st of the calendar year.
The only exception to the annual assessment is for owners who are over 90 years of age. It is the owners responsibility to report and show proof of age to the BPOA. The person must be listed on the deed as an owner. A trustee does not qualify for this waiver.
Voting rights are clearly defined in the NC Planned Communities Act based upon the lot. Therefore an owner is considered to be a lot owner. If the individual or group of individuals (co-owners) owns more than one lot, each lot is considered as a single vote which can be divided by co-owners by the percentage of ownership.
For operational voting, only BPOA members in good standing are permitted to vote. For covenant (By-laws or Declaration of Restrictions amendments) allow all owners to vote.
The board voted to modify our ownership change policy on November 8, 2023.
In the past, any Deed declarations registered on Pender County Recorder of Deeds are changes of ownership and result in a fee assessment.
The new change of ownership policy is
"A 'change of ownership' from any newly registered deed to quitclaim, gift, 'for life', or revocable trust deed resulting in at least one pre-2006 owner still having a portion of the ownership is not considered a transfer of ownership."
Affected owners are being notified prior to the 2024 invoicing cycle.
All ownership changes after March 31st, 2006, result in mandatory membership in the BPOA, HOA for Belvedere Plantation Sections I & II, per by-laws from early 2006.
Per the by-laws, a mid-year change of deed resulting in no partial ownership by any pre-2006 owner requires a subsequent payment since they are new owners.
Per the by-laws, a transfer fee is charged of 100% of the annual membership dues amount for purchase between January 1st and June 30th of the dues calendar year of 50% between July 1st and December 31st.
A proxy for General Membership and Special meetings is available. The proxy is valid for the specified General or Special meeting and adjournments thereof.
A proxy form will always be made available on or before the formal announcement of the specified meeting. The member may specify the Board or another owner. If an operational vote is held, only members in good standing in attendance or proxy signed by a member in good standing are valid.
A proxy is superseded by in-person attendance or by a later dated proxy or by a signed cancelation of proxy.
