After a student has been identified as an English language learner, the parent/guardians must be notified in writing. This letter is sent from the district HLS Registrar. The letter specifies the student designation as an ELL and it explains the type of services that the child will receive. Our district department will send each school these letters for the student.
The parent/guardian has the right to opt-out of ELD services at any time. This must be done in writing. The student is then exempt from language development services, but must still take the ACCESS for ELLs assessment. The student may also continue to receive test accommodations. If the student is not making adequate progress and/or they are not able to access core content, the parent must be notified and encouraged to opt-in to ELD services. Regardless of their decision, no student can be denied education, so the school must give students any services that are needed, including English language development services.
If a parent reaches out to the CLDE Specialist wanting to opt their student out of CLDE services, please speak directly with the parent and discuss the following points with them.
Before initial discussion with parents (if possible), research the student's assessment data. Look at and collect:
ACCESS/screener data with individual domain scores,
State assessment data (CMAS, DIBELs, SAT, etc.)
Local assessment data (Renaissance Assessment, writing samples, classroom data, teacher input, etc.) to get a picture of the whole student.
When communicating with the families explain the benefits of the program.
Discuss the student’s assessment data and that language support will increase the student’s opportunity for success in school and assessments.
Being bilingual is an asset to your child. We strongly encourage families to continue to develop the child’s native language. However, students learning two languages may need additional exposure to the academic language necessary to succeed academically as they progress through school.
Students may be socially fluent in the language, but struggle with the academic language that is required in school.
The class supports their success in core classes.
The class provides additional opportunities for reading, writing, speaking, and listening in academic English.
If the family still wants to opt their child out of language supports, they will need to fill out the Opt-Out form which then should be sent to the CLDE department coordinators. (NOT AVAILABLE ON WEBSITE. Email the district team)
Highlight key points with the parents.
The district must still meet your child's language development needs in the classroom. CLDE specialists will monitor the student's progress in the classroom and provide support as needed.
The district must administer the ACCESS annual assessment until the student has demonstrated English Language Proficiency based on the assessment and a body of evidence regardless of the refusal of services.
Additionally, families will be required to fill out the Opt-Out form annually.
Once the parents have returned the Opt Out form, please forward the signed form to the CLDE coordinators and HLS registrar for appropriate documentation.
