EL PRESIDENTE DE LA REPÚBLICA, en uso de sus facultades constitucionales y legales,

Que conforme al artículo 64 de la Constitución Política de la República de Panamá, el Estado está obligado a elaborar políticas socioeconómicas encaminadas a promover el pleno empleo y asegurar a todo trabajador las condiciones necesarias para una existencia decorosa;

Que uno de los Lineamientos de Política Institucional del Ministerio Trabajo y Desarrollo Laboral consiste en el desarrollo de las políticas de capacitación y promoción de empleo orientadas, entre otros, a fomentar programas de capacitación y de empleo para jóvenes que, por razones económicas o familiares, no logran completar su formación académica;

Que la mencionada política de capacitación y promoción de empleos se orienta, asimismo, a la inserción laboral de nuevos profesionales con el propósito de evitar el desplazamiento de la mano de obra calificada, que promuevan la capacitación dentro de la empresa, para reducir la fuga de profesionales y coordinar acciones que generen empleos en favor de los profesionales;

Que los Objetivos de Desarrollo Sostenible (ODS) de la Organización de las Naciones Unidas (ONU), adoptados por la República de Panamá, mediante el Decreto Ejecutivo N° 393 de 14 de septiembre de 2015, en el Objetivo 8, denominado "Promover el crecimiento económico inclusivo y sostenible, el empleo y el trabajo decente para todos", contempla en la meta 8.6, la reducción considerable de la "proporción de jóvenes que no están empleados y no cursan estudios ni reciben capacitación";

Que la Ley 121 de 30 de diciembre de 2019, "Que crea el Proyecto Aprender Haciendo para incentivar la oferta de primer empleo a jóvenes en el sector privado", tiene la finalidad de contribuir a la disminución de la tasa de desempleo en jóvenes de diecisiete (17) a veinticuatro (24) años, mediante pasantías laborales en un entorno empresarial, supervisado y guiado por especialistas en empleabilidad, a través de la capacitación, certificación y orientación de jóvenes panameños con formación académica;

THE PRESIDENT OF THE REPUBLIC in use of his constitutional and legal powers, 

That in accordance with article 64 of the Political Constitution of the Republic of Panama, the State is obliged to develop socio-economic policies aimed at promoting full employment and ensuring all workers the necessary conditions for a decent existence;

That one of the Institutional Policy Guidelines of the Ministry of Labor and Labor Development consists of the development of training and employment promotion policies aimed, among others, at promoting training and employment programs for young people who, for economic or family reasons, fail to complete their academic training;

That the aforementioned training and job promotion policy is also aimed at the labor insertion of new professionals in order to avoid the displacement of qualified labor, which promote training within the company, to reduce the flight of professionals and coordinate actions that generate jobs in favor of professionals;

That the Sustainable Development Goals (SDGs) of the United Nations (UN), adopted by the Republic of Panama, through Executive Decree No. 393 of September 14, 2015, in Goal 8, entitled "Promote inclusive and sustainable economic growth, employment and decent work for all", contemplates in target 8.6, the considerable reduction of the "proportion of young people who are not employed, in education or training";

That Law 121 of December 30, 2019, "That creates the Learning by Doing Project to encourage the offer of first employment to young people in the private sector", is intended to contribute to the decrease in the unemployment rate in young people from seventeen (17) to twenty-four (24) years old, through work internships in a business environment, supervised and guided by employability specialists, through the training, certification and guidance of young Panamanians with academic training;

THE PRESIDENT OF THE REPUBLIC, in use of his constitutional and legal powers,

That in accordance with Article 64 of the Political Constitution of the Republic of Panama, the State is obliged to develop socio-economic policies aimed at promoting full employment and ensuring that all workers have the necessary conditions for a decent existence;

That one of the Institutional Policy Guidelines of the Ministry of Labour and Labour Development consists of the development of training and employment promotion policies aimed, among others, at promoting training and employment programmes for young people who, for economic or family reasons, are unable to complete their academic education;

That the aforementioned training and employment promotion policy is also aimed at the labour insertion of new professionals with the purpose of avoiding the displacement of skilled labour, promoting training within the company, in order to reduce the drain of professionals and coordinating actions that generate jobs in favour of professionals;

That the Sustainable Development Goals (SDGs) of the United Nations (UN), adopted by the Republic of Panama, through Executive Decree No. 393 of 14 September 2015, in Goal 8, entitled "Promote inclusive and sustainable economic growth, employment and decent work for all", includes in target 8.6, the significant reduction of the "proportion of young people who are not employed and are not in education or training";
